Biomedical research involving human subjects is an experimental behaviourwhich treat healthy people or patients as the object of study. It uses the interventivemeasures which have not been determined and/or authenticated and aims to developthe clinical application of new medicine medicines, medical apparatus andinstruments and new medical technology. Along with the development of medicalsciences biomedical research has attached more importance to people and alsoaroused dispute in practice. The most important factor of the dispute is that thesubject is not properly protected.As a developing country, biomedical fields situation in our country is not in theleading position in the world and so that human trials and the subjects have not gottenas much intension attention as they should. As the medical technology level increasesthe number of subjects involved in researches is increasing. Because of theinformation unequal situation, they often stand at the weak trend position withoutself-determination and the right to informed consent. Discipline the research behaviorand Protect the legitimate rights of subjects are extremely urgent.The paper will introduce the basic concept of biomedical research involvinghuman subjects and make a review of this period of its history, and expound thecontents of the subjects’ legal benefits and reveal the status quo and the problems ofsafeguard subjects’ legal benefits in our country by analyze typical cases. Meanwhile,this article, based on empirical study tries to investigate the objective conditions andsubjective perceptions of investigators and subjects in all phases of the process in biomedical research including the recruitment,the process of informing and thesigning of the informed consent,the course of the trial and the compensation ofdamage. And then the paper analyzes and discusses the survey results and putsforward suggestions and assumption on the protection on human subjects’ rights andinterests.
