Study On Collaborative Governance Of Cross-border E-commerce Intellectual Property Customs Protection In Shandong Province

Entering the 21st century,as our country is gradually moving towards a strong country in intellectual property protection,the emphasis on intellectual property rights and protection capabilities have been raised to a new level.In order to build and improve a more complete intellectual property law,management and policy system,build a timely and reasonable intellectual property rule system,improve the protection system represented by the judicial protection and administrative protection systems,and improve the coordinated protection of unified leadership,smooth conduction,and rapid response The pattern,on September 22,2021,the Central Committee of the Communist Party of China and the State Council issued the "Outline for Building an Intellectual Property Powerful Country(2021-2035)",and guided by this document,we will continue to strengthen my country’s intellectual property protection capabilities.Accordingly,this paper takes collaborative governance as the starting point,takes Shandong customs as the main perspective,finds out the collaborative dilemma of customs protection of cross-border e-commerce intellectual property rights in Shandong,and puts forward optimization countermeasures based on this.Specifically,this paper starts with the rapid evolution characteristics of cross-border e-commerce,the frequent discovery of infringements,and the importance of countries and regions,and proposes the necessity of strengthening the collaborative governance of customs protection of cross-border e-commerce intellectual property rights in Shandong.In addition,referring to the multi-center collaborative governance theory and the SFIC(Starting conditions,Facilitative leadership,Institutional design,and Collaborative process)collaborative governance model,this paper conducts a feasibility analysis and finds that each governance body participating in the collaboration There are advantages such as consistent synergy motives,complementary governance resources,and historical synergy experience among them.Customs can be used as a catalyst to carry out collaborative governance activities.In addition,this paper combines the weak links of internal synergy,vertical synergy and social synergy existing in the collaborative governance of cross-border e-commerce intellectual property rights customs protection in Shandong,and proposes three strategies to improve the governance efficiency of governance subjects,innovate collaborative governance models,and strengthen social synergy concepts.An optimization approach to enhance the collaborative efficiency of customs protection of intellectual property rights in cross-border e-commerce in Shandong.
