With the development of global economic and technological integration,owning independent intellectual property rights has become a key factor to promote the sustainable development of national economy and society,and countries all over the world pay more attention to the protection of intellectual property rights.In recent years,international trade is in a downturn period,and international trade frictions are becoming more frequent.Intellectual property has become an important means and tool for commercial negotiation and market competition.At the same time,our economy is also transforming to high quality development,introducing high quality foreign investment can bring competition effect and technology spillover effect,and it is an important way to promote technological innovation level.On the above background,intellectual property rights have become one of the important features of international trade,and the intellectual property rights regime has attracted increasing attention in the world,among which the impact of intellectual property protection regime on foreign direct investment has also attracted much attention.At this time,the complex relationship between intellectual property protection and foreign direct investment is discussed.This thesis explores how to make good use of the leverage regulation effect of intellectual property regime in the growing international trade friction,which is the policy choice question closely related to the national industrial policy,investment policy,science and technology policy and so on,to attract foreign capital to our country,optimize foreign capital structure,enhance foreign capital utilization level,promote our country technological innovation and promote highquality economic development has important practical significance.This thesis selects panel data of 30 provinces(excluding Tibet)during the 20 years from 2000 to 2019 as research samples.On the basis of combing existing literature research results and relevant theories of international direct investment,theoretical analysis is carried out in combination with China’s current national conditions and development status,and then appropriate variables are selected.Multiple linear regression model was established and the least square method was used to empirically test the effect of the protection level of intellectual property on the flow of foreign direct investment.The results show that the level of intellectual property protection plays a significant role in promoting the inflow of foreign direct investment.The eastern region is the most sensitive to the promotion effect,followed by the central region,and the western and northeast regions are not significant.At the same time,the improvement of intellectual property protection level will promote the inflow of foreign direct investment through stimulating local independent innovation ability.Moreover,labor cost and market potential play a moderating role in the promotion process of foreign direct investment by intellectual property protection level,among which the promotion effect of intellectual property protection level on foreign direct investment will be weakened with the increase of labor cost,but strengthened with the expansion of market potential.
