In recent years,the problem of educational punishment in Colleges and universities has become increasingly prominent.Students’ anomie behavior appears more frequently,and there are more and more complex situations.There are also a lot of irregularities in the process of exercising the function of disciplinary management in Colleges and universities.For example,the disciplinary tort of teachers,the negative disciplinary behavior of college teachers,and the blocked relief channels for students’ rights and interests appear in people’s sight.However,in the current university management system,there are no precise disciplinary measures for students’ fault behavior.At the same time,the educational punishment in Colleges and universities has failed to achieve its due social recognition.This problem has aroused widespread concern in the academic circles,and the legitimacy and limit of educational punishment in Colleges and universities need to be clarified.With the implementation of the strategy of governing the country and education according to law,the process of legalization in China has been significantly accelerated,and the discipline in Colleges and universities has gradually stepped into the track of rule of law.Under the environment of gradual and steady progress in the construction of the rule of law in education in the new era,How to clarify the legitimacy and legitimate value of the disciplinary power of higher education? How to clarify the boundary and procedural norms of the implementation of educational disciplinary power in Colleges and universities? All kinds of problems need to be discussed,so as to promote the return of higher education punishment to the educational standard of Building Morality and cultivating people,and ensure the smooth development of higher education and teaching process.The research on these problems is a subject of great theoretical and practical significance.Based on the development status of educational punishment,the demand of the times for talents and the need for the construction of the rule of law in Colleges and universities,this study hopes to provide development support for the theory of educational punishment power in Colleges and universities by interpreting the origin and legitimacy of educational punishment power in Colleges and Universities.By using the methods of literature analysis and comparative analysis,this paper analyzes the connotation,nature and origin of the educational disciplinary power in Colleges and universities.This paper makes a detailed distinction between the legitimacy of the disciplinary power of higher education.The article also distinguishes the legitimacy and rationality of the power of punishment in higher education,and further discusses the limits and principles of the implementation of punishment.This paper analyzes the problems and difficulties in the practice of higher education due to the unclear legitimacy and boundary of educational disciplinary power.Educational discipline is a necessary part of the complete educational process.The negative evaluation and discipline of college educational discipline on students’ anomie behavior is a necessary means to maintain the order of college education and teaching,shape students’ good personality and promote the all-round development of students.This has distinctive educational value and is an active choice to meet the practical needs of society for high-quality and comprehensive talents.Promoting the quality development of higher education and promoting the group of college students to grasp self-development and growth can better serve the society and the country and need the realistic realization of the disciplinary power of higher education.The above contents are because the disciplinary power of higher education has its own historical,legal and social origins.In order to sort out the role of higher education punishment in the quality assurance of higher education development,the relationship between legal rights and responsibilities in the subject and object of higher education punishment power,the progress of social civilization and the punishment effect activated by individual social norms.From multidisciplinary perspective,this paper discusses and analyzes the legitimacy of disciplinary power in Colleges and universities.Punishment has its "good" effect and "evil" value.Schools and teachers have the ethical responsibility to reasonably exercise the right of punishment.Based on the original motivation of "following the good",the code of conduct of "justice" and the final direction of "happiness",the proper implementation of the right of punishment in higher education is the pursuit of the value of "harmony".By clarifying the boundary of college education punishing students’ anomie behavior,and grasps the limitation of the punishment implementation procedure of improving higher education management.In the process of implementing the disciplinary power of higher education,we should pay attention to the appropriateness,hierarchy and flexibility of the implementation mode,carry out the implementation with reasonable,reasonable and legal normative requirements,and ensure the legitimacy,necessity,fairness and educational principles of discipline in the process of implementation.
