Psychiatry is one of the essential departments in hospitals.Compared with other departments,its treatment methods and management models have certain differences,such as not allowing accompanying caregivers and implementing closed management.In addition,due to the special nature of the patients received by psychiatry,the incidence of medical damage events is somewhat higher.Medical damage judicial appraisal involves almost all departments of the hospital,including psychiatry,of course.Judicial appraisal of medical damage in psychiatry,as a post-procedure to resolve medical damage-related liability issues,can provide necessary theoretical and practical data support to alleviate doctor-patient disputes in psychiatry and reduce the incidence of psychiatric medical disputes by exploring its quality influencing factors.Starting from analyzing typical cases and 226 psychiatric medical dispute cases from the judgment document network,this study discussed the practical difficulties of judicial appraisal of medical damage in psychiatry.The empirical study reveals that the probability of medical disputes in psychiatric departments of comprehensive hospitals is relatively high.The violations of nursing obligations,attention obligations,and diagnostic and treatment obligations are major medical malpractices in psychiatric departments.Institutions with forensic psychiatric evaluation qualifications appraised the lowest proportion of cases involving psychiatric medical disputes.The main reasons for judicial appraisal institutions to reject psychiatric medical damage cases are "appraisal requirements exceeding the business scope of the institution" and "objections to materials."Drawing on the empirical analysis,this study provided a comprehensive analysis of the current state and factors influencing the judicial appraisal of medical damage in psychiatry,considering legal regulations and appraisal practice.This mainly includes the redundancy and contradictions in legal norms related to psychiatric medical disputes,inconsistent management standards for appraisers’ qualifications,ambiguous scope of practice for appraisers,inadequate management and operation of appraisal equipment,formalistic appraisal material collection and review,and insufficient appraisal standards.To address the above issues,this study aimed to establish a quality control system for judicial appraisal of psychiatric medical damage,focusing on pre-monitoring,in-monitoring,and post-monitoring.Pre-monitoring seeks to standardize appraisers’ admission qualifications and improve their practice qualifications.In-monitoring aims to standardize the collection and preservation of appraisal materials,clarify appraisal assistants’ auxiliary responsibilities,enhance the hearing system for psychiatric medical damage,review judicial appraisal opinions,and propose Guidelines for Judicial Appraisal of Psychiatric Medical Damage.Post-monitoring mainly involves the improvement of a complaint handling mechanism for judicial appraisal cases that are publicly accessible and interpretable,and the improvement of a smart judicial appraisal system that covers the entire chain and all factors.To summarize,this study used typical cases of psychiatric medical damage as a foundation and introduced 226 cases of psychiatric judicial documents.It employed statistical analysis theory to analyze the current state of psychiatric medical damage judicial identification in China.Addressing problems such as the insufficient qualifications and standards of psychiatric medical damage judicial identification personnel,the study concentrated on drafting the Guidelines for Judicial Appraisal of Psychiatric Medical Damage to offer guidance for the practice of psychiatric medical damage judicial identification.
