Research On The Construction Of Legal Mechanism For Economic Cooperation In The Framework Of Shanghai Cooperation Organization

International economic cooperation is the main driving force and an important source of economic growth in the world today.In the process of cooperation,the development of legal mechanisms for economic cooperation is an important entry point for the systematic construction of harmonious regional economic development.The Shanghai Cooperation Organization(SCO)is the first regional international organization established at the initiative of China.Since its establishment,the SCO has steadily moved forward with the initial goal of maintaining regional peace,security and stability.In recent years,based on the need for transformation of international organizations,the SCO has gradually paid attention to cooperation in economic and trade aspects,and the comprehensive promotion of regional economic cooperation has become a new goal and new content to promote the social progress and economic prosperity of each member state,thus the construction of the legal system of economic cooperation is particularly important The legal system of economic cooperation is particularly important.Based on the interpretation of economic cooperation and its legal mechanism within the framework of Shanghai Cooperation Organization,this paper analyzes the manifestations and causes of the lack of legal mechanism of international economic cooperation of the organization,explains the necessity and feasibility of constructing legal mechanism of international economic cooperation of the organization,and focuses on the path and measures of constructing legal mechanism of international economic cooperation of the organization.This paper is of high theoretical value and practical significance to the construction of the legal mechanism of the organization,especially to further strengthen the economic cooperation among the member countries of the organization in the fields of production and trade,and to promote the equality and mutual benefit,cooperation and economic development among them.Excluding the introduction,this paper is divided into four parts.The first part interprets the interpretation of economic cooperation and its legal mechanism within the framework of Shanghai Cooperation Organization(SCO).Firstly,the concept,characteristics,types and modes of SCO economic cooperation are explained.Secondly,the concept of SCO economic cooperation legal mechanism and its proper features are explained: organization,systemic,coordination and predictability.Finally,the experience of building legal mechanisms of economic cooperation of other international organizations is drawn.The aim is to lay the theoretical foundation for how to build the legal mechanism of the organization.The second part analyzes the manifestations and causes of the lack of legal mechanisms for economic cooperation within the framework of the Shanghai Cooperation Organization.The main manifestations of the lack of legal mechanism for international economic cooperation in the SCO are as follows: the lack of efficient voting principles in the field of economic cooperation;the lack of operable legal rules;and the lack of competent institutions for economic cooperation.The reasons for the lack of legal mechanism of international economic cooperation in the organization are: the member states ignore the importance of economic cooperation in the organization;the geopolitical game affects the centripetal force of the member states towards the organization;the differences in economic development limit the depth of economic cooperation.The third part discusses the necessity and feasibility of constructing a legal mechanism for economic cooperation within the framework of the Shanghai Cooperation Organization.The feasibility of the legal mechanism of economic cooperation within the framework of the Shanghai Cooperation Organization is not only the need of the international organization itself,but also the need of the member states;its feasibility is mainly expressed as follows: the political foundation is more solid;the economic foundation of economic and trade cooperation is further consolidated;the legal foundation is further strengthened.The fourth part discusses the construction of the legal mechanism of economic cooperation within the framework of the Shanghai Cooperation Organization.The path to be followed and the measures to be taken for the construction of the legal mechanism for international economic cooperation of the organization are as follows: First,a basic agreement should be reached.The content of the agreement should include: the status and purpose of the basic agreement;the system and application of the basic agreement;the legal principles of economic cooperation established by the basic agreement.Secondly,a special legal body should be set up and its nature,composition and its functions should be defined.At the same time,the voting procedure of this special legal body should be determined.Finally,other relevant legal systems should be improved,including: the establishment of an information sharing system;the establishment of a foreign-related legal service sharing system;and the establishment of a dispute settlement system.Thus,the legal mechanism for international economic cooperation of the organization can effectively play its due role in maintaining regional security and promoting healthy and harmonious development of regional economy.
