Investigation And Research On Dai Customary Law In H Village Of Dehong Prefecture

The customary law of the Dai ethnic group described in this article refers to the long-term production and life in the Dai area,formed in the traditional customs,moral norms,codes of conduct,and mutual aid and other informal,in the Dai society.The sum of generally binding norms of behavior.It is a means of adjustment to the problems and contradictions in real production and life,and at the same time plays a guiding role in dealing with and resolving disputes among the Dai people.It is closely related to the life of the Dai people and affects all aspects of the life of the Dai people within a certain range.This paper takes the natural village of H Dai ethnic group as the research object,collects relevant data through field investigation,describes the origin and realistic performance of the customary law of H Dai ethnic group,and analyzes the supplementary role and active integration of the customary law of H Dai ethnic group to the ethnic law under the background of the comprehensive promotion of the rule of law.This paper is mainly composed of the following four parts :The first part of this paper aims to introduce the research status,value and significance of the customary law of the Dai ethnic group in H village,and explain the research objects and research methods.In addition,it will briefly introduce the basic situation of H village and the process of field investigation.The second part describes the origin of the customary law of the Dai ethnic group in H village.From the existence conditions and social functions of the customary law of the Dai ethnic group,this paper examines the formation process of the customary law of the Dai ethnic group in H village.It mainly expounds the original belief,taboo of life,stage of social and economic development and ethnic psychology of H village,which plays a subtle role in the daily life and moral education of the Dai people in H village for a long time.The third part summarizes the customary law of Dai ethnic group in H village,and expounds the active customary law of Dai ethnic group in H village from the aspects of organization form,public security maintenance,marriage and family and traditional dispute resolution mechanism.These customary laws have played an active role in safeguarding the agricultural economy,protecting the legitimate rights and interests of villages,resolving village conflicts,and maintaining social stability in H village.The fourth part analyzes the positive role of the customary law of the Dai ethnic group in H village in the context of the promotion of the rule of law and the contemporary changes and causes of the customary law of the Dai ethnic group in H village.This paper expounds the relationship between customary law and national law,and explains the supplementary role of customary law in maintaining social stability,reducing conflicts and ensuring people ’s livelihood.
