Since 1981,when the first property management company was established in Shenzhen City,the property service industry has developed in China for more than 40 years.In 2003,the State Council issued the first administrative regulations at the national level---"Property Management Regulations”,marking that the development of the property management and property service industry in China ushered into the track of nomocracy.Since the formal promulgation and implementation of "Z Province Property Management Regulations".It plays an important role in regulating the property service industry in Z province.It’s very important for local government through the promulgation of local laws and regulations to regulate the property management work and property service industry.But with the development of economy and social progress,whether "Z Province property management Regulations" also matches the current social reality is a question to be studied.It is also urgent to investigate and study whether the effectiveness,rationality and adaptability should be further enriched and improved to meet the realistic needs of the current social development.The author takes the "Property Management Regulations of Z Province" as the research object.When the author practiced in the Standing Committee of the People’s Congress of a city in Z Province,on the basis of collecting a large number of documents,visiting and investigating major property service enterprises,and interviewing owners,the author tries to sort out the problems existing in the implementation process of the"Property Management Regulations of Z Province”.The author also hope to analyze the reasons and put forward improvement measures and suggestions.This paper mainly carries out research from the following four parts:The first part is the fundamental state.First of all,this paper discusses the reasons for selecting G District of D City as the research site of "Property Management Regulations of Z Province”.Secondly,through summarizing the research data,this paper analyzes the implementation status of "Property Management Regulations of Z Province" in G District of D City.The second part is the achievement after the promulgation of "Z Province Property Management Regulations".Firstly,it highlights the role of the owners’ meeting and the owners’ committee in the process of community governance.Secondly,it clarifies the responsibilities of the management department and the principal position of the owner.Thirdly,it makes clear the charging way of property service.Finally,it standardizes and broadens the use of special maintenance funds for residential buildings.The third part is the problem of the "Z Provincial Property Management Regulations".First of all,the division of the rights,obligations and responsibilities of the parties needs to be clarified;Secondly,the legitimate rights and interests of the owners need to be protected and strengthened;Thirdly,the service quality and charging standard of property service enterprises need to be regulated;Finally,the process of payment,storage,use and supervision of residential special maintenance funds needs to be sorted out.The fourth part is countermeasures and suggestions for "Z province property management Regulations".First of all,the rights,responsibilities and obligations of the parties should be further clarified;The second is to further strengthen and protect the legitimate rights and interests of the owners;Thirdly,the service quality and charging standard of property service enterprises should be further standardized;In addition,the process of payment,storage,use and supervision of housing special maintenance funds should be further regulated.Finally,we should further improve the post-legislative evaluation and regular research system of the implementation effect of the regulations.
