Empirical Study On Court-appointed Mediation In S County People’s Court

The 20 th Congress report of the Communist Party of China pointed out the need to improve the social governance system,adhere to and develop the "Fengqiao Experience" at the grassroots level in the new era,improve the mechanism for correctly handling contradictions among the people in the new situation,and timely resolve conflicts and disputes at the grassroots level and in their infancy.In today’s society,the contradictions and disputes that people face are becoming more diversified,and traditional litigation methods are no longer able to meet the needs of the parties or effectively resolve conflicts and disputes in a timely manner.Taking the diversified dispute resolution mechanism as a way to resolve current conflicts and disputes has significant practical significance.Delegated mediation,as a important link in the diversified dispute resolution mechanism,not only can ease the burden on the court but also provide the parties with more flexible and efficient ways to resolve disputes.In recent years,it has been actively promoted and applied by courts across the country.This article starts from the practice of delegated mediation in the S County People’s Court,analyzes its current situation,and proposes some targeted suggestions to promote the optimization and benign development of delegated mediation.Apart from the introduction and conclusion,the article is divided into three parts:The first part introduces the basic situation of delegated mediation in the S County People’s Court.In this part,the article makes a detailed discussion on the selection of the investigation site and sorts out and analyzes the investigation data.The data covers the operation of delegated mediation in the S County People’s Court from May 2020 to December2022,mainly including the scope of cases of delegated mediation,the distribution of delegated mediation subjects,the connection between delegated mediation and the litigation procedure,and the effectiveness of delegated mediation.The second part,through a detailed analysis of the investigation data and situation in the first part,identifies the following problems in the implementation of delegated mediation in the S County People’s Court: first,the start-up procedure of delegated mediation is not standardized enough;second,the distribution of delegated mediation subjects is imbalanced;third,the connection between delegated mediation and the litigation procedure lacks effective coordination;fourth,the effectiveness of delegated mediation is not satisfactory.The third part proposes improvement suggestions for the existing problems.The suggestions include: first,strictly standardizing the start-up procedure of delegated mediation;second,reasonably distributing the number of cases received by delegated mediation subjects;third,improving the connection mechanism between delegated mediation and the litigation procedure;fourth,enhancing the effectiveness of delegated mediation.
