The issue of “agriculture,rural areas and farmers” is a key issue in the development stage of my country’s economic and social transformation,and rural housing mortgage loans are one of the important solutions to the financing problem of“agriculture,rural areas and farmers”.Rural housing mortgage loan is a financial innovation product bred by capitalization of rural idle resources.However,there are still legal dilemmas and legal risks such as lack of legal basis and mortgage restriction in the later stages of the pilot.In addition,due to the imperfect prevention and control,implementation and supporting mechanisms of comprehensive risk,the comprehensive promotion of rural housing mortgage loan policies is largely restricted.The release of open and policy effects.Based on the reform pilot area in Liuyang City,this article discusses the policy practice process of rural housing mortgage loans in Liuyang City in the order of its reform and development time,and further summarizes the development characteristics and successful experience.In order to comprehensively analyze the legal risks of rural housing mortgage loans in Liuyang City,based on the summary of the Liuyang pilot system,analyze the conflicts between legal prohibitions in the operation of the policy and the principle of integration of housing and land,restricted use rights,difficulties in disposal,and poor transaction mechanisms.And other legal dilemmas.Following the concept of legal dilemma to legal risk,using the method of subject classification,from the perspectives of farmers,village committees,local governments and commercial banks,it is concluded that policy operation may face breach of mortgage contract,power rent-seeking,and improper interference in land use,etc.Legal risks,and further sorted out and analyzed possible legal risks induced by the lack of usufructuary rights of homesteads,poor connection between legal norms and reform policies,inaccurate function positioning of village committees,and lack of risk prevention and control systems for financial institutions.factor.Finally,based on the successful experience of Liuyang’s risk regulation establishment system and strong implementation,perfect and put forward regulatory suggestions on the legal risks of farm house mortgage loans nationwide,construct specific implementation methods on the basis of the suggestions for improving farm house mortgage loans,and improve the risks.A supporting system to prevent and build a systematic legal risk regulation system,to improve the national pilot and national level legal improvement and system construction to contribute Liuyang experience.
