Times are changing,and the Internet is also upgrading.The development mode of the Internet is changing from the national Internet to the national network,and the Internet mode has brought a lot of entertainment for the public,and people can use the Internet platform to release their own life fun.User-generated content(UGC)is based on the development of the Internet.As an emerging form of work and a part of the concept of Web 2.0,it is developing rapidly on the Internet platform with its unique characteristics.However,not all user-generated content(UGC)belong to the works protected by the copyright law.Only the user-generated content(UGC)with originality and reflecting certain self-expression and ideological value belong to the category of copyright law works.Based on this,user-generated content brings huge economic benefits,but also generates some copyright protection problems,so how to protect the copyright of UGC will also become a problem that the legal community has to pay attention to.This paper is divided into four chapters except for the introduction.Study respectively is: the first chapter,the concept of user generated content(UGC)definition,the characteristics and classification discrimination,and then the user generated content(UGC)of the legal relationship and copyright legitimacy theory is analyzed,it is concluded that the original user generated content belongs to work,should be protected by the copyright law.In the second chapter,the analysis found that the application scope of user-generated content(UGC)is limited in rational use,traditional censorship obligation and copyright license,and the difficulties brought to the copyright law are analyzed.The rise of user-generated content not only changes the environment on which the copyright law originally relied,but also damages user interests under the weakening of the copyright restriction system.Both the limitations of rational use,the lack of traditional censorship obligations or the inefficiency of the copyright licensing system will affect the development of user-generated content(UGC).In the third chapter,we compare and analyze the legislation and judicial practice of user-generated content(UGC)outside the region,so as to provide reference suggestions for the improvement of copyright law in the next step.In the fourth chapter,by summarizing the experience of off-domain user-generated content(UGC)in copyright protection,and comprehensively considering the current system of user-generated content copyright protection in China,it puts forward some suggestions on the rational use of user-generated content,traditional censorship obligations and copyright licensing system. |
