| This paper takes compulsory isolation measures in public health emergencies as the entry point,and uses literature research,annotation analysis and empirical research methods to study compulsory isolation measures at four levels:enforcement subjects,application conditions,implementation methods and relief channels.Through sorting out the current situation of the implementation of compulsory isolation measures in the prevention and control of the new epidemic,and summarising typical incidents and cases,it was found that the legality of compulsory isolation measures implemented by some subjects is not sufficient,the role of some medical institutions as enforcement subjects is questionable,the determination of close contacts is too broad,the scope of compulsory isolation subjects is arbitrarily expanded,the implementation of compulsory isolation measures is The implementation of compulsory isolation measures is obviously inappropriate,there are procedural loopholes in the implementation of compulsory isolation measures,the lack of timely and effective remedies for rights,the lack of compensation mechanisms for compulsory isolation measures,and so on.On the basis of this,and taking into account the actual situation in China,it is proposed to clarify the scope of the subject of enforcement and its authority at the grassroots level,to limit the scope of medical institutions as the subject of enforcement,to strictly enforce the criteria for determining close contacts,to restrict the scope of subjects subject to compulsory isolation measures,to regulate the implementation methods of compulsory isolation measures,to comply with the legal procedures for implementing compulsory isolation measures,to enrich the remedies for compulsory isolation measures,and to establish a compensation mechanism for compulsory isolation measures.The recommendations include the following It is hoped that this will be beneficial to the improvement of compulsory isolation measures in public health emergencies in China. |
