Legaland Compliance Review Of Party Normative Documents

The legal and compliant review of the Party’s normative documents aims at at ensuring the unity of the Party’s policies,its internal regulations and its normative documents,and is the fundamental way to implement the CPC’s strict governance over the Party.At the same time,it is conducive to the supervision of the formulation of the subject,so as to achieve the purpose of restricting the power within the party.Only by paying attention to the legal and compliance review of the Party’s normative documents can it be conducive to the Party’s self-construction and create a good legal environment for the construction of the rule of law in China.Since the revision of the CPC Provisions on the Filing and Examination of Internal Regulations and Normative Documents in 2019,the central and local governments have conducted a lot of practice on legal compliance review,and scholars have also conducted theoretical research on this.In this context,the author draws lessons from the advanced experience of national law related systems,and gives specific suggestions to improve the new problems: the review standard is vague,review method is not complete,and the review procedure and supporting mechanism is not perfect.The text of this article covers the following three parts:The first part is the relevant concept of the legal compliance review of the party’s normative documents.It first starts with the party’s normative documents,scientifically expounds its meaning,defines its unique attributes,and compares the similarities and differences between it and the party’s regulations and administrative normative documents,so as to lay a theoretical foundation for the following demonstration.Secondly,it discusses the relevant concepts of legal compliance review,and focuses on its definition and application.Finally,the significance of the legal compliance review of the party’s normative documents is the basis for strengthening legislative supervision,an inevitable choice to improve the party’s laws and regulations system,and an inevitable requirement for maintaining the unity of China’s legal system.The second part is the current situation analysis of the legal compliance review of the party’s normative documents.Based on the current theoretical research results and combined with the actual work of the normative legal compliance review of the central and local parties,the analysis and summarizes the areas that need to be detailed: review standards,review methods,review procedures and supporting mechanisms.The fourth part is to improve the suggestions,and put forward detailed suggestions on the above areas that need to be detailed: clearly stipulate the review standard terms,construct the review benchmark and improve the processing mechanism,increase the review method,improve the review process and its supporting mechanism.
