Research On Space Station Jurisdictional Issues From The Perspective Of International Cooperation

With the development of manned space technology,the Salutation series space stations,Mir Space Station,the U.S.Skylab,the International Space Station,and the Chinese Space Station have entered space.Based on the characteristics of high construction cost and technical complexity of space stations,it is necessary to launch international cooperation.This paper focuses on the jurisdictional issues of space stations from the perspective of international cooperation and on the premise of clarifying the principles of non-appropriation of outer space and freedom of exploration and use of outer space,especially to clarify the relevant concepts and theoretical basis of space station jurisdiction,and to provide reference for thefuture jurisdictional arrangements of Chinese Space Station by analyzing the relevant international legal and regulatory situation and the existing international practical experience of space station.The study mainly applies a historical and comparative approach by sorting out and interpreting theories and treaties in order to argue the trend of open cooperation in today’s world and the future jurisdictional direction of China.Many of the current articles focus on the space legislation situation and are not systematic enough for jurisdictional studies.This paper focuses on the new situation of international cooperation,and discusses jurisdictional issues in the perspective of international cooperation based on the background that the Chinese Space Station will be completed in 2022.Now that international cooperation has become a reality,it is necessary to comprehensively study the jurisdictional issues of the space station in order to deal with the series of legal issues that arise afterwards.In the study of the jurisdiction of space stations,there are different views on the application of the concept of quasi-territorial jurisdiction;in terms of personal jurisdiction,the definition of the identity of outer space visitors and the jurisdictional standards of outer space visitors and astronauts have not been decided;in terms of protective jurisdiction,the criminal jurisdiction system of International Space Station also has certain shortcomings,and the localization of this system in Chinese Space Station also needs to be explored;and the path to resolution when there is a conflict of jurisdiction is critical.This paper will analyze and consider the above key issues and clarify the logic of space station jurisdiction.
