An Empirical Study On The Criminal Behavior Of Mafia And Evil Forces

Cracking down on crimes committed by underworld and evil forces is an unavoidable problem in the social governance of our country.On the issues related to criminal law,there is little research on the analysis of crimes committed by criminal and evil forces.The criminal behavior of the criminal and evil forces is diverse,changeable and complex.The empirical study on the criminal behavior of the criminal and evil forces can be based on the relevant definition of criminal law and the theoretical focus of the characteristics of the criminal and evil forces.This paper focuses on the analysis of the accusation opinions of public prosecution organs,defense opinions,organizational forms of criminal and evil forces,means of criminal acts of criminal forces,nature and frequency of criminal acts involved,judgment results and other factors in practical cases.This paper focuses on the analysis of the behavior characteristics,behavior patterns and profit-seeking behavior of the underworld and evil forces.In practice,a large number of typical violence adopted by mafia and evil forces include both violence against people and violence against things,and "soft violence" can be divided into nuisance "soft violence",threatening "soft violence",online "soft violence" and offline "soft violence",among which nuisance "soft violence" is adopted more times.In addition,taking the economic basis of the underworld and evil forces as the starting point,this paper studies and collates the means of profit-seeking behavior,the location of the behavior,the charges involved in the behavior and other factors carried out by the mafia and evil forces in the field of legal and illegal industries,so as to clarify the importance of economic gains to the mafia and evil forces.it shows that what is hidden behind the profit-seeking behavior of the evil forces is the violent acts they have committed in various industries,and the acts are becoming more and more hidden.Therefore,from the perspective of behavior,it is necessary to normalize the treatment of crimes committed by criminal and evil forces:first of all,from the perspective of "soft violence",it is emphasized that the handling of cases of "soft violence" of criminal and evil forces must be strictly in accordance with the principle of legality of crime and punishment.Secondly,from the point of view of the economic sources of the underworld and evil forces,and on the basis of rectifying various industries,it is emphasized that all governance subjects should take the initiative to cooperate,actively give full play to the functions of the people’s courts and people’s procuratorates,and do a good job in case guidance.To carry out judicial recommendations,it is necessary to achieve multi-department cooperation.In addition,from the point of view of depriving the evil forces of the proceeds from their crimes,it is emphasized that in order to improve the handling and enforcement of the property involved in the crimes committed by the evil forces,it is necessary to pay attention to the departmental linkage mechanism to "cut off money and blood" in practice,and to control the crimes committed by the criminal and evil forces from the source and prevention.
