Research On Anti-domestic Violence In China

Family is the cell of society,the harmony and stability of a small family is related to the harmony of the big family of society,and a long-term and common factor that affects and destroys family harmony is the existence of domestic violence.So domestic violence is a stable and harmonious society must pay attention to the problem.The year 2023 marks the 7th anniversary of the implementation of China’s Anti-Domestic Violence Law.Taking this as an opportunity,the author finds and excavates the shortcomings and challenges existing in China’s current anti-domestic violence practice and the implementation of the Anti-Domestic Violence Law through empirical research,and fully draws on the leading theories and practical measures in the field of anti-domestic violence overseas.Based on the legal regulation of domestic violence,judicial intervention and social rescue practice,we try to put forward feasible and constructive suggestions for counter-domestic violence countermeasures.From the definition and characteristics of domestic violence,this paper analyzes the types of domestic violence and the reasons for anti-domestic violence.By analyzing the current situation and deficiencies of anti-domestic violence from three aspects of legal regulation,judicial intervention and social aid,it concludes that the current legal regulation content is not enough to deal with the complex situation of domestic violence and needs to be deepened.At present,the judicial intervention process is not complete,the procedure is not closely connected,and there are still many defects in the trial stage.At present,it is difficult for the social assistance mechanism to provide an effective role in the dispute resolution of anti-domestic violence practice.Based on foreign experience in anti-domestic violence,this paper puts forward corresponding suggestions for improving anti-domestic violence countermeasures in our country,including: deepening the legal regulations on antidomestic violence,including optimizing the system of habeas corpus,perfecting the compulsory reporting system,perfecting the warning system,and expanding the scope of domestic violence behavior modes.Improving judicial intervention in domestic violence,including setting up anti-domestic violence police team,improving evidence rules in domestic violence cases,setting up domestic violence courts;Improving social assistance against domestic violence includes: improving the shelter system,setting up a domestic violence prevention and Treatment committee,promoting the establishment of antidomestic violence centers,dividing the responsibilities of domestic violence relief units,and forming a social linkage model against domestic violence.
