With the development of online shopping,more and more consumers are choosing to buy goods or services online.In the online shopping environment,consumers’ personal information often contains huge potential commercial value,and therefore,cases of leakage of online consumers’ personal information occur from time to time.In practice,online shopping platforms usually have a large amount of personal information of consumers,which will certainly have a certain impact and threat on the maintenance of legitimate rights and interests of online consumers and the normal order of market transactions.Although China has enacted laws and regulations such as the Consumer Rights and Interests Protection Law and the Personal Information Protection Law,the protection of personal information of Internet consumers still faces many difficulties under the current system.In view of this,this paper attempts to study the legal issues of consumer personal information protection in China’s online shopping environment based on the existing laws and regulations,and proposes suggestions for improving the protection of consumers’ personal information in China based on the advanced legislation and practical experience from overseas.In general,except for the introduction and conclusion,this paper is divided into four chapters to discuss the protection of consumers’ personal information in the online shopping environment.The first chapter first defines the basic concepts related to personal information in online shopping.It mainly includes the concept and characteristics of personal information,and the identification of consumer personal information and related concepts.Secondly,a distinction is made between the types of personal information infringing on consumers in online shopping.Finally,the paper discusses the necessity of setting up the personal information protection system of consumers in the online shopping environment from three aspects: the vulnerable position of consumers in online shopping,the special nature of consumers’ personal information,and the fact that the existing legal norms have not been specifically regulated.The second chapter first introduces the current status of legislation on the protection of consumers’ personal information in China.Provisions for the protection of consumers’ personal information are mainly distributed in the Civil Code,the Consumer Rights and Interests Protection Law and the Personal Information Protection Law.Secondly,by analyzing the current situation of consumer personal information protection in China,we can find that there are still many problems in the protection of personal information of online consumers.The third chapter compares the legal systems of the United States,the European Union,and Japan regarding the protection of consumers’ personal information.By comparing the legislation and enforcement systems of foreign countries,we summarize the relevant experiences and draw out the inspiration points for the protection of consumers’ personal information of online shopping in China.The fourth chapter argues how to effectively respond to the dilemma of protecting consumers’ personal information in the online shopping environment at the legal level.It includes the following three aspects: first,to improve the system of rights and obligations for the protection of consumers’ personal information in online shopping;Second,improve the public interest litigation system for personal information of online consumers;and third,to strengthen the all-round regulatory measures for online shopping platforms.
