Research On Protection Of Rights And Interests Of Gig Workers In Digital Economy Era

With the development of advanced technologies such as big data,artificial intelligence,Internet of Things,cloud computing and blockchain,the world has entered the era of digital economy.Since 2020,China’s economic development has withstood multiple tests such as complex and severe international environment and domestic epidemic distribution,especially in the context of economic downturn and structural adjustment,"employment stabilization" has become the focus of policy,and the highly flexible "gig economy" has also embarked on the fast track.The part-time economy plays a positive role in creating employment,revitalizing the microeconomy,reducing enterprise costs and increasing workers’ income.However,many problems are faced in China’s gig market,which brings severe challenge to China’s existing labor laws and regulations,social security,definition of work forms and so on.Therefore,it is necessary to strengthen the supervision of the gig economy,improve the labor and employment system of gig workers,implement the responsibility of enterprise management,supervise the platform data algorithm,enhance the synergy of social organizations,provide basic security for gig workers,protect their labor rights and interests in multiple dimensions,and promote the healthy development of gig economy.Under the guidance of Sandeval’s labor relations theory and collaborative governance theory,this paper summarizes the domestic policies related to the development of the gig economy,the protection of the rights,the interests of gig workers and the implementation of measures in Tianjin.Based on the survey of the questionnaire and interview forms of the gig workers in Tianjin,this paper carries out relevant research on the protection of the rights and interests of gig workers.The problems of unclear labor relations,imperfect labor security and negative cognition of rights and interests in the protection of the rights and interests of gig workers are analyzed.information,technology and concept,and explore the construction of "1+2+N+4" collaborative governance framework,i.e.focus on one goal,adhere to two directions,promote multiple governances,compact four levels,comprehensively sort out legal responsibilities and standardize the establishment of responsibility list.From the toplevel design led by the government,the mechanism innovation of enterprise governance,the collective rights of organization collaboration,and the individual development incentive of concept transformation,we propose countermeasures and suggestions for the long-term governance of the protection of rights and interests of odd jobs in the digital economy.It effectively maintains the overall planning of industry development,data control and algorithm monitoring,coordination of interests of multiple subjects and supervision of each department,compacts the responsibilities of collective and individual at all levels,refines the functions of authority and accelerates the implementation of measures.Regarding the protection of the rights and interests of gig workers,the academic community has never stopped studying theoretical construction and practical application.The strategies and trends of Tianjin,which relies on the development of Beijing-Tianjin-Hebei urban agglomeration and the sinking of industrial digital technology,thus enabling the regional synergistic development of digital economy,have made the development of the gig economy in Tianjin promising and promoting the further development of the urban agglomeration and the formation of a new highly aggregated area.It is of great theoretical and practical significance to pilot study of the current situation and rights protection of gig workers in Tianjin,strengthen the government’s regional governance capacity,and extend the study from the region to the whole country to improve the policies and measures on the rights and interests of gig workers in various industries.
