Research On The Practical Characteristics And Value Of Xi Jinping Thought On The Rule Of Law

Xi Jinping Thought on the Rule of Law,responding to the challenges,requirements and expectations of the situation of the world and the Party,was formally put forward in November 2020 and became a theoretical guide for Advancing Law-Based Governance.As China’s legal cause continuously has made new achievements,and the practical characteristics of Xi Jinping Thought on the Rule of Law have become increasingly prominent.Taking the practical characteristics as the main body for research,not only can we have a look at the logical system of Xi Jinping Thought on the Rule of Law,further clarify the theoretical strength of the new path of Chinese-style rule of law modernization,but also can help us correctly grasp the practical character,practical strength and practical path of socialist rule of law construction with Chinese characteristics,and deepen the theoretical cognition of China’s rule of law construction at this stage.At present,in terms of the practical characteristics of Xi Jinping Thought on the Rule of Law,foreign scholars tend to focus on the dimensions of state machine operation and policy processing and discuss Xi Jinping Thought on the Rule of Law from the perspective of current politics.Domestic research focuses on the practical goals,practical system,and practical capabilities of Xi Jinping’s thought on the rule of law.This paper takes the practical characteristics and value of Xi Jinping’s thought on the rule of law as the research object.First,Xi Jinping’s thought on the rule of law is the core concept of this paper.Taking its production conditions and practical connotation as the research entry point,it defines the research scope of this paper.Second,sort out the practical evolution and main achievements of Xi Jinping’s thought on the rule of law,and analyze the vertical development and horizontal expansion of the practice guided by Xi Jinping’s thought on the rule of law.According to the clues of the practice of the rule of law in the city-province-country,the formation of Xi Jinping’s thought on the rule of law is divided into three stages: preliminary exploration,preliminary deliberation and comprehensive implementation.In the development of the rule of law over time,great achievements such as the basic formation of the overall pattern of comprehensive law-based governance,the continuous improvement of the socialist judicial system and mechanisms,and the further implementation of the protection of the people’s interests have been presented.Third,summarize the practical characteristics of Xi Jinping’s thought on the rule of law,that is,innovation development,system coordination and dialectical unity.Innovation development is based on the Marxist rule of law theory,Sinicization of Marxist rule of law thought and the excellent traditional Chinese legal culture,and fully absorbs the characteristics of theoretical nutrients and practical experience.System coordination is based on the “overall situation”(“domestic and international situation” “The Five-sphere Integrated Plan” and “Four Comprehensives”,“strategic overall situation for the great rejuvenation of the Chinese nation” and “once-in-a-century global changes”),Systematically coordinates the construction of the rule of law government,rule of law economy,rule of law culture,rule of law society,and rule of law ecological civilization,realizes the gradual development of the legislative system from top to bottom and bottom to top,from partial to overall law enforcement system,and from “procedure” to“substantial” public participation.Comprehensive implementation pays attention to the various issues and mutual relations of the rule of law in an all-round way,and consciously integrates the rule of law and the rule of the party,the rule of law and the rule of virtue,the comprehensive deepening of reform and the rule of law in an all-round way.Fourth,based on the basic grasp of the practical characteristics,analyze the value and character of the practical characteristics of Xi Jinping’s thought on the rule of law in the contemporary era.
