Research On The Circulation Dispute And Resolution Of The Rural Land Contract Management Right In Xiangshui County

Land is the most basic element in agricultural production and an important means of production for farmers to survive.It has irreplaceable characteristics.Therefore,deepening the reform of the rural land system and solving the land problem are of great significance to my country’s realization of a strong agriculture,rural beauty and farmers’ wealth.The report of the 19 th National Congress of the Communist Party of China proposed to implement the strategy of rural revitalization,and promote farmers to transfer their land contractual management rights as assets,so that the land contracted management rights in the hands of farmers can realize the transformation of continuous income from property.However,in recent years,disputes over the transfer of land contracting management rights in Xiangshui County and even in many rural areas across the country have remained high.Most of these disputes involve a wide range of areas,high social attention,and difficulty in handling.The stable development of society has had a large negative impact.With this as a background,to effectively resolve the disputes arising from the process of rural land contracting,the significance of this research is very important from a theoretical and practical point of view.This article takes the circulation of rural land contractual management rights in Xiangshui County,Jiangsu Province and the status quo of dispute resolution as the research object,and explains from the perspectives of background and research significance.Dispute and other related concepts are defined,the main structure of the text is analyzed in terms of research content and methods,and the shortcomings in this article are explained.Combined with the current research situation of domestic and foreign scholars,the content of the literature related to the subject of this article is analyzed.,To analyze the two theoretical foundations used in the research of this article.Then introduced the basic situation of selected Xiangshui County,the current status of the transfer of rural land contract management rights in Xiangshui County,and summarized the characteristics of large transfer scale,diversified transfer forms,and gradual diversification of transfer subjects.At the same time,it pointed out the high status of disputes over the transfer of rural land contractual management rights in Xiangshui County,and summarized the four main reasons for disputes: disputes caused by unwritten land transfer contracts,disputes caused by the illegal exercise of powers by grassroots governments or village cadres,and land Disputes caused by the unclear agreement of the swap period,and disputes caused by breach of contract driven by economic interests.Finally,it introduces the main methods of Xiangshui County to resolve disputes over the transfer of rural land contractual management rights.Through analysis of typical cases in disputes over the transfer of rural contracting management rights in Xiangshui County,combined with research,it is further summarized that relevant personnel have weak legal awareness,grass-roots cadres lack effective supervision,dispute resolution and coordination mechanisms are not sound enough,and the channels for petitioning and rights protection lack pertinence.The inadequate implementation of agricultural social security,etc.Xiangshui County resolves the five problems in the disputes over the transfer of rural land contractual management rights.Finally,a detailed analysis of the phenomenon of multiple disputes over the transfer of land management rights in Xiangshui County is carried out to find out the phenomenon.the reason.In response to the above problems,the article proposes countermeasures and suggestions for prevention and resolution from different levels.Through strengthening the legal awareness of all parties,strengthening the supervision and management of grassroots cadres,building a standardized and orderly alternative dispute resolution mechanism,improving the efficient circulation of disputes letter and visit mechanism,and establishing and improving the agricultural-related social security system.Shui County provides some ideas for resolving similar disputes,so as to provide some references and lessons for resolving disputes about the circulation of land contracting management rights that are common in rural areas in my country.
