As the Internet industry enters a new era,Internet platforms have gradually evolved into giant platforms with absolute or relative market dominance by virtue of their initial data flow accumulation.In the fierce market competition,in order to consolidate market share,Internet platform blocking behaviors are constantly staged,which not only undermine the orderly competition of the Internet market and harm the rights and interests of platform users,but also hinder technological innovation to a certain extent.Because the platform economy has "dual attributes",the relevant market is difficult to define and data monopoly and other new characteristics different from traditional monopoly behavior,making China’s competition law can not accurately apply to the reality of the platform blocking behavior,mainly because of the rapid development of the Internet platform economy and the contradiction between the existing competition law legislation lags behind.Therefore,how to regulate market competition and promote benign market development in the new market environment has become an urgent problem to be solved.Based on the nature and characteristics of Internet platform blocking behavior and its illegality in the current competition law system,this study analyzes the logical starting point of its regulation,and summarizes the problems of the governance of this behavior under the current competition law system by combining the typical judicial cases involving Internet platform blocking behavior at home and abroad,and in response to these problems,it is proposed to strengthen the legislative guidance of interconnection,promoting the legislation of "gatekeeper" platform regulation,promoting the statutory interconnection authorization model,improving the prior competition law compliance mechanism for Internet platform enterprises,improving the data legislation to clarify data ownership,clarifying the interpretive position of data constituting necessary facilities,and diversified and collaborative governance,so as to help China’s healthy and sustainable development of the Internet industry.
