| Medical disputes arise in social communication,and have the general characteristics of social contradictions and its own particularity and complexity.Our country has been looking for effective ways to solve medical disputes.With the development of the modernization of the rule of law in the society,the pluralistic pattern of resolving medical disputes has basically formed.Although a variety of solutions have been established,but there are still shortcomings and problems in practice,hindering the role of the settlement mechanism.In this paper,taking Guizhou province as an example,through a large number of relevant literature collection,and participate in observing the process of dispute resolution and conduct in-depth interviews with relevant personnel,according to the practice feedback,this paper analyzes the problems involved in the settlement of doctor-patient dispute,so as to have an overall grasp of the problems existing in the practice of the settlement of doctor-patient dispute in our country.On this basis,following the multi-concept of“Overall prior mediation” and“Judicial Final Settlement” of the dispute settlement mechanism with Chinese characteristics,this paper puts forward some suggestions for improving the core mechanism of multi-resolution of medical disputes,and in view of the matching measure existence hindrance gives the solution countermeasure.At the same time,from the overall perspective of social rule of law,explore the construction of public legal service system to build a“Full-time space,full-service,full-coverage” multi-resolution system of medical disputes.Finally,it is necessary to construct a diversified and long-term mechanism for resolving medical disputes,to promote the resolution of medical disputes,to restore the harmonious relationship between doctors and patients,and to create a stable and orderly medical environment,we will promote the steady and high-quality development of medical and health services,and accelerate the process of building a country governed by the rule of law. |
