Action Study On Village-level Organizations Mediating Civil Disputes Under The Perspective Of New Institutionalis

Resolving conflicts and disputes at the grass-roots level and building a stable and harmonious rural social order is an important guarantee to achieve good governance in rural areas.In rural society,village organizations,as the most basic organizations facing the villagers,constantly respond to the topic of "resolving disputes at the grass-roots level" in their governance practice,resolve disputes in the local area,and play a key role in dispute mediation.How this specific dispute mediation process occurs has become the focus of this study.This study takes the village organizations of C village in Guizhou Province as the research object.Through field research and data collected by semi-structured interview and participatory observation,this study explores the action basis and specific dispute mediation strategies of the village organizations in dispute mediation from the perspective of new institutionalism theory,and studies and analyzes its specific mediation actions.The study has the following findings.First of all,village organizations play a key role in dispute mediation,which cannot be separated from the local context and institutional environment(composed of formal and informal institutions)of "the decline of original mediation authority and the lack of exogenous mediation authority".Secondly,the institutional environment provides institutional guarantee and cultural support for the mediation actions of village organizations,constitutes the action basis of village organizations,and guides the mediation practice of village organizations.To be specific,under the support and constraints of the institutional environment,village organizations will carry out the action of civil dispute mediation under the motivation of improving the efficiency of mediation and obtaining external recognition,presenting the action strategy of pursuing efficiency and legitimacy.Finally,the village organizations constantly accumulate the efficiency and legitimacy of their actions in the mediation practice to realize the local settlement of disputes.This mediation practice is of great significance for the better construction of safe villages and the promotion of good rural governance.
