Research On The Governance Of Illegal Firearms Manufacturing And Trafficking In China

In recent years,with the increasing popularity of the Internet,the online shopping industry,which is closely related to it,has also shown vigorous vitality,promoting the rapid development of the shipping and logistics industry.With the platform of the Internet,the crime of illegal manufacturing and trafficking of firearms has rapidly spread and expanded into virtual space,posing a brand new proposition for the governance of gun-related crimes in China at present.Guns and their recognition criteria are the logical starting point for criminal justice.There is a discrepancy between the ordinary empirical meaning of "firearms" and the legal professional regulations,and the criteria for determining "firearms" have also experienced a change from "shooting at a pine board" to "shooting at a pig’s eye".The standard for determining "firearms" has also changed from "shooting at a pine board" to "shooting at a pig’s eye".In the internet era,illegal firearms manufacturing and trafficking crimes exist in both offline and online ways,posing a great danger to public security.Data from judicial cases can intuitively reflect the dynamics of illegal firearms manufacturing and trafficking crimes in China.The empirical investigation of the current situation of illegal gun trafficking crimes in the Internet era is carried out in a combination of point and surface approaches: on the "surface",the data on the number of cases and geographical distribution of gun trafficking in China from 2012 to 2021 are selected,in an attempt to present the overall picture of illegal gun trafficking crimes in China during the decade;on the "point",the data on the number of cases and geographical distribution of gun trafficking crimes in China from 2020 are selected.On the other hand,the three provinces of Yunnan,Guizhou and Sichuan have been selected as the sample for analysis,with a view to revealing the common characteristics and problems of illegal firearms trafficking crimes in China.The new characteristics of gun trafficking crimes in the internet era have brought about new dilemmas in governance,manifesting themselves in the confusion faced by legal responses,the difficulties faced by case investigation and the difficulties faced by social prevention and control.For the current illegal gun trafficking crime governance exists "legal queasy-investigation backward-lack of prevention and control" of the triple dilemma,it is urgent to build the corresponding response mechanism.The first is to improve the legal response mechanism,build a dichotomy between administrative and criminal firearms recognition standards,add legislative provisions for the control of nail guns and easy-to-make firearms and improve the corresponding criminal law and regulation strategies.Secondly,we should establish an information-based collaborative investigation mechanism,set up special investigation teams,improve information monitoring technology,and open up the collaboration mechanism between multiple departments,judicial organs and internet enterprises.Third,improve the social prevention and control mechanism,strengthen the control of information network platforms and the logistics and delivery industries,and establish a dynamic monitoring mechanism for groups prone to gun involvement and easy-to-make firearms;strengthen publicity and education,and encourage the public to provide crime clues.
