| On the 20 th National Congress of the Communist Party of China(CPC),the General Secretary Xi Jinping pointed out that: Corruption is a cancer to the vitality and ability of the Party,and fighting corruption is the most thorough kind of self-reform there is.The properties declaration and disclosure system by public officials is a world-recognized effective system for preventing and controlling corruption,as well as a system which would ensure the effective public supervision of the public officials.At present,there is at least 137 countries and regions around the world have implemented the property declaration and disclosure system by public officials.While,China is also exploring and promoting the system.The "Regulations on Reporting Personal Matters by Leading Cadres" issued by the General Office of the Communist Party of China and the General Office of the State Council in May2010 and revised in April 2017 are only party regulations and have not yet been elevated to the level of national law.Thus,there are frequent occurrences of failure to truthfully declare or in accordance with regulations,the results of the declaration are not made public and the public’s awareness is limited.Besides,the subject of the declaration is limited to leading cadres at or above the deputy division chief level which means it does not cover the section chief level leading cadres and key position management personnel in the public officials.Additionally,the supporting system is lacking and the verification to the declaration is not strict.Moreover,the punishment for false declaration is insufficient which is limited to party disciplinary action and promotion restrictions.In summary,these problems are unlikely to meet the requirements of the " Winning the tough and protracted battle against corruption " proposed by General Secretary Xi Jinping at the 20 th Party Congress.Taking a problem-oriented approach and focusing on the effectiveness of the system in preventing corruption,this research uses a combination of comparative studies and case analyses to summarize the experience of the development of the system of reporting personal matters by leading cadres in China,examine the practices of property declaration and disclosure by public officials in some foreign countries or regions,and analyze the current phenomena of new type corruption and hidden corruption,demonstrating the important preventive function and practical value of the system of property declaration and disclosure for public officials in key areas with concentrated power,intensive funding,and abundant resources,and for corruption that is more prominent in terms of industry,system,and region.Furthermore,in this thesis,suggestions are made to further improve China’s system of property declaration by public officials,including analyzing the shortcomings of the property declaration and disclosure system by public officials,improving the "Regulations on Reporting Personal Matters by Leading Cadres" as a party regulation,advancing the national legislation of the system,implementing the disclosure of declaration results,expanding the scope of the declaration subject,enriching the content of declaration items,improving the declaration verification mechanism,and imposing severe punishment for false declaration behavior.This research will further improve China’s system of property declaration by public officials,and better leverage its institutional function in promoting the "not dare to corrupt,not able to corrupt,and not willing to corrupt" in the fight against corruption,consolidating and developing the achievements of the anti-corruption struggle. |
