| Since the online operation of the national online mediation platform for futures disputes,it has been affected by the basic unit elements such as the absence of legal rules and the complexity of network technology.It has not provided the two parties to futures disputes with better dispute resolution guarantee,and has not yet realized the deep coupling of online network and traditional mediation service system in the root end of technological reshaping.Specifically,the mechanism mainly has problems such as incomplete supporting legal provisions,immature online connection mechanism with other judicial organs,insufficient development of case handling function of the online platform and insufficient funds for mediation.In view of the existing problems of online mediation mechanism of futures disputes,it can be improved from the legal and technical aspects.In terms of law,the legal system of online mediation of futures disputes should be improved,the industry rules applicable to the mediation process of various associations should be standardized,the existing online mediation fee burden mechanism should be optimized,the online mediation fee classification system should be implemented,and the mediation fund of securities and futures disputes should be established.In terms of network technology,it is necessary to build a one-stop dispute resolution platform program,improve the platform’s auxiliary capacity for handling cases,pay attention to the futures dispute litigation and mediation docking mechanism,and break through the information barriers between industrial mediation and other mediation channels. |
