With the emergence of new words such as "995","996" and "strivers agreement",workers chose to swallow their anger in the face of these "unequal treaties".Employers ignore the existence of the law and often violate employees’ right to rest,and employers infringe on employees’ right to rest in an endless stream,and the voice of society for protecting employees’ right to rest is also increasing.China’s right to rest is stipulated in the Constitution in the form of a separate article,which is sufficient to prove the importance of human rights protection in our country.Not only the Constitution stipulates that workers’ right to rest,but other laws and administrative regulations stipulate this.However,whether from the legislative level or from the practical point of view,there are certain problems in the protection of the right to rest of workers in China.This article is divided into five parts in terms of article structure.The first part mainly introduces the relevant theories of workers’ right to rest,expounds the concept of workers’ right to rest,and reinterprets the scope of workers,the object of the right to rest and the content of the right to rest.Then,from the perspective of human rights,society,and workers themselves,the significance of guaranteeing workers’ right to rest is analyzed.The second part describes the historical development of workers’ right to rest at home and abroad and its legal provisions,respectively,from the world’s historical development of workers’ right to rest and its legal regulations,mainly from the historical development of workers’ right to rest and legal regulations after the founding of New China.The third part mainly describes the current state of legislation on the right to extraterritorial rest and its enlightenment to China through four countries,France,the United States,Germany and Japan.The fourth part is mainly the problems existing in the protection of workers’ right to rest,such as the actual guarantee of workers’ right to rest,the lack of supervision,the incomplete remedy of workers’ right to rest,and the low independence between trade unions and enterprises.The fifth part is to strengthen the protection of workers’ right to rest in China,mainly corresponding to the problems in the protection of workers’ right to rest proposed in Part IV,such as refining the legislation on the right to rest,strengthening the supervision system of the right to rest,strengthening the means of remedy for workers’ right to rest,improving the independence between trade unions and enterprises,and improving the awareness of workers’ right to rest.The author hopes that the above suggestions will effectively protect the rights and interests of Chinese workers.
