Research On The Mediation Mechanism Of The Icsid

With the continuous development of economic globalization,international investment has become more frequent,and there have been more and more international investment disputes.The existing international investment dispute settlement mechanism gradually reveals many deficiencies and loopholes,and the international community calls for the reform of the investment dispute settlement mechanism more and more strongly.The investment mediation mechanism has the advantages of being able to resolve international investment disputes economically and quickly,being conducive to maintain the friendly and cooperative relationship between the parties,and the control of the parties over the dispute settlement.Therefore,it has become one of the key points of the reform of the investment dispute resolution mechanism.As a representative institution for the settlement of international investment disputes,ICSID is committed to promote the corresponding reform of its mediation mechanism.Although it has great value in developing the investment mediation mechanism for ICSID,it also faces the internal dilemma that the lack of enforce-ability of the settlement agreement reached through mediation,the conflict between the confidentiality of mediation and the transparency of dispute resolution,and the lack of diversity in the professional fields of mediator.And the external dilemma that the host country is more reluctant to apply mediation.In this regard,we can take methods in the " Singapore Convention on Mediation" to improve the enforce-ability of reconciliation agreements,reasonably balance the conflict between confidentiality and transparency,increase the professional diversity of mediators,and do a great job in publicizing the mediation mechanism and establishing a training mechanism for government officials to break through the internal and external difficulties existing in the development of the mediation mechanism of the ICSID.At present,mediation plays an extremely important role as a way of resolving international investment disputes.Therefore,relevant research and discussion on it will have a profound impact on promoting the continuous improvement of the mediation mechanism of the ICSID and the promotion of international investment.
