Reswarch On The Legal System Of Government Information Disclosure Upon Application

The system of government information disclosure upon application is the core of the government information disclosure system.The system of government information disclosure upon application gives citizens the right to apply for government information disclosure,so that the protection of citizens’ right to information does not remain only a pale slogan.The system provides that applicants can seek government information disclosure by way of application,which objectively maximizes the use of government information and helps build a“government under the sun” while protecting citizens’ right to know.The legal basis of China’s government information disclosure system upon application is mainly reflected on The People’s Republic of China Government Information Disclosure Regulations.In 2019,The People’s Republic of China Government Information Disclosure Regulations were revised and implemented,improving the relevant provisions on disclosure upon application,filling the legal loopholes of disclosure upon application,and ushering in a new era for the system of disclosure of government information upon application.However,as practice has unfolded in recent years,prominent problems have emerged in the field of public disclosure on application,such as “weakening of people’s right to know”,“abuse of the right to apply”,and “imbalance between the right to know and the right to privacy”.Citizens’ right to know is not guaranteed,irregular applicants crowd limited administrative resources,and administrative organs have difficulty balancing the right to know and the right to privacy,which seriously restrict the development of the government information disclosure system.This paper aims to take the problem as the starting point,draw on overseas experience and combine it with the actual situation in China,and propose the path to solve the problem from the perspectives of establishing the constitutional status of the right to information.By focusing on the hot issues in the current system of government information disclosure upon application,this paper clarifies the relevant legal concepts,improve the regulatory measures,increase the antecedent regulations,and improve the system of relief for personal privacy,etc.
