| In recent years,the aging phenomenon in China has become increasingly severe.The elderly and those with physical and mental disabilities constitute a widely group of the voluntary guardianship system.Article 26 of the Law on the Protection of the Rights and Interests of the Elderly,Article 33 of General Provisions of the Civil Law and Article 33 of the Civil Code are all special provisions on the voluntary guardianship system,and the voluntary guardianship system has gradually come into the view of the people.At present,the voluntary guardianship system of our country is still in its infancy,and it has many shortcomings due to its summary legislation.Our supervision of voluntary guardianship only remains in the afterwards supervision stage.From the structure of voluntary guardianship system,it mainly has three problems: unreasonable setup of supervision subjects,vague rights and responsibilities of the supervision subjects and lack of supervision of the whole process.It shows that our country has not formed a freewill guardianship supervision system.There are obvious deficiencies in the protection of the wards.In view of the shortcomings of the determined guardianship system,the thesis discusses deeply and systematically the selection of supervisors,the responsibilities of supervisors and the improvement of the supervision process.this paper holds that that our country should adopt the dual-track system of determined guardianship supervision model,which aims to construct an voluntary guardianship supervision system in which each supervisory subject is responsible for the whole process of supervising adult voluntary guardianship through collaboration and cooperation. |
