Reconstruction Of The Rapid Examination System For Green Technology Patents

As one of the effective methods to solve the ecological environment crisis advocated by various countries,the patent examination system closely related to technological innovation needs to respond to it.However,my country’s policy preference for green technology patent examination is mainly based on the priority examination system stipulated in the "Patent Priority Examination Measures",and green technology is not the only service object of this measure.At the same time,the lack of green technology judgment standards makes the implementation of the system lack operation.There is also a gap in the degree of incentives between priority examination and rapid examination,which makes it difficult for my country’s green technology patent applications to meet expectations.In order to stimulate green technology innovation,this paper puts forward the following suggestions for the reconstruction of the green technology patent rapid examination system.First of all,it provides qualitative and quantitative methods for judging the greenness examination requirements that the system serves,that is,green technology patents.Secondly,the "Patent Law" needs to clarify that green technology patents are green technology patents in the form of separate articles,so as to highlight the existence of green technology patents and serve the implementation of the rapid examination system.Finally,it puts forward suggestions on the specific design of the system from the aspects of review procedures,review methods,and restrictive conditions.
