Research On Tolerating Prudential Regulation Of New Business Formats

Today ’s Internet economy is driven by information technology and has developed rapidly.The new format economy characterized by industrial integration has become an important part of the " innovation-driven development strategy".The new business economy represented by platform economy and sharing economy provides information services for market operators and consumers through the Internet platform,and makes full use of idle social resources to create new economic development momentum.Due to the lack of standardized supervision system,there are some problems in the new format market,such as illegal market access,difficult management of market operation,and difficult handling of minor violations.The root cause of market confusion and regulatory difficulties is the conflict between ’ economic innovation ’and ’ legal lag ’.The traditional regulatory system cannot fully and effectively supervise the new format economy.The purpose of supervision is not to limit development,but to promote the healthy and sustainable development of new formats.The " Regulations on Optimizing the Business Environment " proposes to strengthen " inclusive and prudent supervision " for new formats.This paper argues that ’Inclusive Prudential Supervision ’ is applicable to the supervision of new business forms,which is the concentrated embodiment of innovative economic theory,demand spillover theory and administrative law balance theory in the ’ conflict between innovation and legal lag ’.It can effectively solve the contradiction and conflict between the development of new business forms and supervision.The positioning of ’inclusive and prudent supervision ’ should be used as an administrative law enforcement principle to guide the regulatory authorities to build a regulatory system suitable for the characteristics of new formats.On the basis of practical exploration experience,according to the connotation of the principle of inclusive prudential supervision and the characteristics of new business forms,this paper attempts to discuss the specific application ways of the principle of inclusive prudential supervision in the supervision of new business forms from three perspectives : the application of the admission and vacancy approval system of new business forms,the application of the operation and trigger supervision system of new business forms,and the application of the minor violation and exemption system of new business forms,so as to put forward some suggestions for improving the market supervision of new business forms and promoting the optimization of the market environment of new business forms.
