Study On The Review Of Normative Documents For The Record Of The Standing Committee Of The People’s Congress At The County Level

In his report to the 20th Party Congress,Xi Jinping stressed,"Adhering to the rule of law across the board and promoting the construction of China under the rule of law." The review of normative documents for the record by the Standing Committees of the NPC at all levels is an important system for improving the socialist rule of law system and safeguarding the implementation of the Constitution and laws,helping to promote scientific,democratic and lawful legislation,and enhancing the systematic,holistic,synergistic and time-efficient nature of legislation.With the development and improvement in recent years,the filing and review system of the Standing Committee of the National People’s Congress at all levels has gradually matured.However,as the grassroots main body of the system,the county-level NPC standing committees are still in their infancy in the operation of the whole system,and some theoretical and practical issues need further clarification and research.This thesis addresses the problems in the filing and review system of county-level NPC Standing Committees,using the Selected Cases on Filing and Reviewing Normative Documents compiled by the Legal Affairs Working Committee of the Standing Committee of the National People’s Congress as the main source of cases,combining relevant laws and regulations and the views of scholars to conduct research and propose corresponding improvement measures.The text is divided into five parts.The first part is the introduction,which briefly introduces the proposal of the problem,the background and significance of the chosen topic,the literature review and the research methodology.The second part is an overview of the filing and review system of county-level NPC standing committees,including an explanation of the meaning and role of filing and review,a review of the development of the filing and review system of normative documents,a clarification of the principles that county-level NPC standing committees should follow in performing the function of filing and review,and an analysis of the legal attributes of the system.The third part deals with the theoretical ambiguities of the current filing review system of the county-level NPC Standing Committee,and after studying the cases,laws and regulations and relevant documents in the book,this thesis gives the final conclusion for the above issues.The fourth part deals with some practical problems encountered by county-level NPC standing committees in their practical operation,which have seriously restricted the long-term operation of the record review mechanism of county-level NPC standing committees and have affected the legitimate rights and interests of citizens,legal persons and other organizations.In the fifth part,the above-mentioned practical problems are addressed,and relevant suggestions are put forward for the improvement of the record review system of county-level NPC Standing Committees.
