| China’s tobacco industry follows a management system of "unified leadership,vertical management,monopoly and franchise".As an important part of the national economy,the tobacco industry has made outstanding contributions to economic and social development.Faced with new situations and new tasks,the tobacco industry has adhered to the general principle of seeking progress while maintaining stability in accordance with the blueprint for China-style modernization outlined by the Party’s top 20 congresses.We should focus on the supervision work in key areas such as cigarette counterfeiting and smuggling,Internet sales and logistics delivery of cigarettes and abnormal flow of real cigarettes,strengthen policy guidance and service to market players,and supervise according to law and compliance.In order to ensure that the decisions and arrangements of the CPC Central Committee and The State Council are firmly implemented,the work requirements of the leading Party Group of the National Bureau are fully implemented,and the tobacco sector must effectively improve the supervision efficiency.We will solve problems restricting the regulation of the tobacco monopoly market.This paper adopts the literature research method,case analysis method and interview method,and uses the literature research method to collect,summarize and summarize the research status of tobacco monopoly and monopoly supervision.At the same time,the tobacco monopoly and monopoly market supervision in S County is taken as an example.In-depth interviews were conducted with the monopoly law enforcement personnel,case trial personnel,certificate management personnel,business supervision administrators,marketing personnel and logistics personnel of the county bureau(branch),to understand their views on issues related to tobacco market supervision in S County at the present stage.The research shows that there are five problems in the tobacco market of S County.First,the supervision of Internet sales and logistics delivery of cigarettes is difficult,which is mainly affected by the imperfect multi-unit joint supervision and law enforcement mechanism and cross-city joint case handling mechanism within the industry.Second,the special marketing departments have poor effect on the management ability of retail households that do not match the grade,and the linkage of the special sales of retail households that do not match the management ability with the grade is insufficient,especially the supervision dimension of cigarette retail households in chain stores and entertainment service business formats needs to be broadened;Third,the unlicensed operation of cigarette behavior is repeatedly banned,disciplinary strength is weak "low cost" illegal,the lack of targeted "separation" to carry out the problem of unlicensed households can not be cured;Fourthly,the efficiency of case investigation is not high.In terms of "people" and "things",there are two causes,namely the imperfect assessment system of the monopoly inspection team and the incomplete construction of the monopoly information platform within the tobacco industry.Fifth,the effect of the third party’s participation in collaborative regulation is poor.The main reasons are the lack of the ability of the third party to participate in collaborative regulation and the lack of giving full play to the role of retail households in maintaining the order of the cigarette market.By analyzing the causes of these problems,This paper proposes to improve the multi-unit joint supervision and law enforcement mechanism,strengthen cross-city joint law enforcement within the industry,carry out two-way "portrait" on the cigarette market,strengthen the application of "portrait" data,strengthen the multi-department joint reward and punishment mechanism based on "credit management",establish the law popularization and publicity mechanism,improve the monopoly inspection team assessment system,and improve the level of "intelligent supervision" in the tobacco market,enhancing the ability of the third party to participate in collaborative regulation,and giving full play to the role of honesty and mutual assistance groups,hoping to provide useful reference for the tobacco sector to improve the efficiency of market regulation. |
