Research On The Operation Mechanism Of Grassroots People’s Mediation In Ethnic Areas Under The Background Of Great Mediation

With the rapid development of our economy and entering the new period of social transformation,social contradictions and disputes also present the new features of diversity and complexity.Especially in ethnic minority areas,the preservation and continuation of local traditional cultural customs,religious beliefs,and ways of life are in conflict with people’s increasing demands for material life,spiritual culture and other aspects.The types of contradictions and disputes are more complex and changeable,and the difficulty of social governance at the grassroots level is increasing.The single traditional people’s mediation cannot solve the increasingly complex and changeable types of contradictions and disputes.The multi-linkage grand mediation model has emerged in the complex and changeable contradictions and disputes.Due to the different specific conditions in different regions,the specific operation of this multi-linkage development model has not been standardized and mature,but it is effective in preventing conflicts and resolving disputes and reducing the pressure of litigation.Saving social cost has a very important role.The people’s mediation itself is popular and basic,which can be close to people’s lives.The important position of serving as the first line of defense in resolving conflicts and disputes needs to be re-examined.Under the background of large-scale mediation,how to consolidate its basic position in resolving conflicts and disputes at the grassroots level? Integrating multi-party mediation resources to fully improve the ability to resolve grassroots conflicts and disputes has become an important research topic in the study of grassroots social governance ability.In this paper,the operation mechanism of grassroots people’s mediation in ethnic areas under the background of great mediation is taken as a research topic,and the rural areas of M Yao Autonomous County with representative practical experience is taken as a case study.Starting from the logical structure of "background-current situation-mechanism-problem-countermeasure",combining the interview method and case study method on the basis of collating relevant literature,relying on resource integration theory and holistic governance theory,this paper takes the operation mechanism of people’s mediation in rural areas of M Yao Autonomous County as a case study.From the overview of rural people’s mediation work,internal operation mechanism and external linkage operation mechanism of Yao Autonomous County,this paper analyzes the current situation of the operation mechanism of people’s mediation in this region.From the perspective of main body level,legal theory level and resources level,the author analyzes the problems in the internal operation and external linkage of the people’s mediation mechanism in rural areas of the county,such as the blurred boundary of the mediation subject,the lack of legitimate standardization of mediation authority,and the difficulties in the integration of mediation resources.On this basis,in terms of the internal operation of people’s mediation in the region and the linkage with other mediation resources from three aspects of functional positioning,institutional arrangement and resource integration,the paper proposes to reconstruct the basic dispute resolution status of people’s mediation organizations,adhere to pluralistic co-governance,and clarify the functional division of various mediation forces.We should attach greater importance to the judicial confirmation system for people’s mediation agreements,improve the standardized system for the operation of people’s mediation,standardize the joint mediation procedures,and improve the joint mediation mechanism.It is envisaged to integrate grassroots mediation resources,build a professional development path for people’s mediators,integrate multi-party mediation resources,and build a one-stop multi-dispute resolution platform in towns and villages with people’s mediation as the hub.It provides reference for promoting the development of the operation mechanism of grassroots people’s mediation in minority areas.
