Study On Excessive Law Enforcement At The Grassroots Level From The Perspective Of Epidemic Prevention And Control

Since the end of 2019,the massive outbreak of the novel coronavirus has not only caused a huge impact on the production and life of the public,but also posed a serious challenge to the emergency legal norms of all countries.In order to maximize the public interest and protect the lives and property of citizens,governments all over China have adopted strict and effective epidemic prevention policies and measures,which quickly and effectively contained the further spread of the epidemic.China’s epidemic prevention and control work has achieved remarkable results.The orderly implementation of epidemic prevention and control work in China has provided many textbook examples for the world.However,some primary-level administrative bodies unilaterally pursue the effectiveness of epidemic prevention,and fail to adhere to the principle of proportionality in scientifically formulating epidemic prevention policies and deploying epidemic prevention measures,resulting in undue restrictions and constraints on the legitimate rights of administrative counterparts.Moreover,the primary-level administrative bodies’ law-enforcement behaviors during epidemic prevention and control do not meet the requirements of the reasonable administrative principle in the Administrative Law.Therefore,the author first summarized the grassroots epidemic prevention and control law enforcement behavior from the perspective of epidemic prevention and control,clarified the concept and characteristics of grassroots law enforcement from the perspective of epidemic prevention and control,and on this basis,combined with the principle of proportionality,analyzed the grassroots law enforcement behavior from the perspective of epidemic prevention and control should be defined in accordance with the content of the principle of proportionality,so as to try to define the grassroots excessive law enforcement behavior during epidemic prevention and control.The concept,characteristics and classification of excessive law enforcement at grassroots level from the perspective of epidemic prevention and control were summarized.Secondly,it summarized the problems of excessive law enforcement at the grassroots level from the perspective of epidemic prevention and control,and analyzed the causes behind the repeated occurrence of excessive law enforcement at the grassroots level during epidemic prevention and control.Finally,in view of the causes and problems of excessive law enforcement at the grass-roots level from the perspective of epidemic prevention and control,the principle of proportionality is applied to propose perfect measures that can not only maximize the effectiveness of epidemic prevention but also enable the operation of administrative law enforcement power within a reasonable range.
