The Construction Of Honesty In The Professional Ethics Of Judges In China

Since the reform and opening up,judicial justice has become an important guarantee for social stability and national development,and judicial integrity is the protective barrier of judicial justice.As the spokesperson of judicial activities and behavior,the profession of judge plays a key role in it.The exploration of the professional ethics of judges in China has begun to be results,but the research on the construction of integrity has not been complete.At present,the construction of China’s party conduct and clean government and the fight against corruption is still grim and complex,and there is still a long way to go to completely eradicate the soil of judicial corruption.The lack of integrity of judges will lead to improper judicial style and even corruption,seriously affecting the judicial credibility.It is of great significance to pursue the reasons for the lack of honesty in the professional ethics of judges and then improve the construction of honesty for judges,judicial activities and the development of society.This paper comprehensively uses the normative analysis method,empirical analysis and comparative research method to study the construction of honesty in the professional ethics of judges in China.In addition to the introduction and conclusion,this paper is divided into four parts.The first part mainly introduces the construction of the professional ethics and integrity of judges in China.It mainly expounds the concept,content and characteristics of the professional ethics of judges,and expounds the significance of the professional ethics of judges in China and the significance of the construction of the integrity of judges.Then from the ancient Chinese officials and non-corrupt tradition to the new era under the background of the history of the construction of integrity and review,reflects our country since ancient times has attached great importance to the integrity construction of judicial officials integrity,for the role of the judge,integrity is one of the basic qualities,the lack of judicial integrity affect the judicial justice and social development.The second part mainly introduces the legal origin and practical effect and related classic cases in the category of professional ethics of judges in China.The statistics on the data of judges being held accountable from 2003 to 2022 explain that China has achieved practical results in the construction of judges’ integrity.However,according to the analysis of the cases of Jiahui Zhang and Zheng Sun,it is found that the integrity of judges in China still has problems,such as the blurred boundary between lawyers and the prohibition of retired employees.The third part mainly introduces the shortcomings of the integrity construction of judges in China and its reasons.The main shortcomings include the imperfect standard system,the unreasonable criteria for selection and entry,the abuse of power and power alienation in the industry activities,the lack of attention to the activities outside the industry,and the incomplete punishment and supervision system.The main reasons for the above problems include the traditional legal culture of "ritual governance" in China,the lack of attention to the professional ethics education of judges and the backward methods,and the punishment and supervision of judges mainly post-supervision and small supervision,which constitute a certain obstacle to the construction of integrity of judges in China.The fourth part mainly puts forward the countermeasures to improve the construction of honesty in the professional ethics of judges in China.Thirdly,the judge,as the subject of the judge,should strengthen the level of the ability of the judgment and improve the judicial efficiency.Finally,China should strengthen the internal self-discipline and restrict the external behavior.In summary,this paper mainly analyzes the shortcomings of honesty construction in the professional ethics of judges,the legal origin and its practical effect,classic cases and other contents,then draw the countermeasures to strengthen the construction of judges in China.It is pointed out that persistently forging judges worthy of important tasks and strengthening the integrity of judges in China,in order to make Chinese judges give full play to their judicial functions while pursuing to ensure judicial integrity,of great significance to the construction and development of the socialist rule of law in China.To make new contributions to the comprehensive building of a modern socialist country and to comprehensively advancing the great rejuvenation of the Chinese nation.
