| As an important part of national land policy,agricultural land expropriation aims at promoting economic and social development.However,in the expropriation of agricultural land,the protection of farmers’ rights and interests has attracted much attention.In the expropriation of agricultural land,there may be some infringement of the rights and interests of the land-lost farmers.The purpose of this paper is to discuss the protection of farmers’ rights and interests in the expropriation of agricultural land,and put forward a perfect solution.From the structure of the paper: first of all,the paper combs the concept of agricultural land expropriation,nature,characteristics and hidden dangers.Secondly,the article defines the content of farmers’ rights and interests,including the right to know,the right to participate,the right to compensation,the right to social security and resettlement,and the right to relief.Then,the paper analyzes the problems existing in the protection of farmers’ rights and interests,including the right to know and participation rights are not fully shared,the right to compensation is not effectively guaranteed,the social security settlement mechanism is not perfect,farmers’ relief rights are not in place,etc.Finally,this paper puts forward the following improvement plans: First,we should improve the system of information disclosure and farmer participation,increase the information informed,and protect farmers’ right to know and right to participate.Second,we should improve the compensation system of agricultural land expropriation,raise the compensation standard,unify the identification of collective members and improve the compensation distribution and supervision system.Third,we should improve the social security and resettlement system,establish a sound social security and resettlement mechanism,and improve the diversity and adaptability of resettlement methods.Fourthly,we should improve the relief system and establish a special relief fund to provide financial relief for farmers who have suffered heavy losses.In a word,protecting farmers’ rights and interests is very important in the acquisition of agricultural land.The solutions proposed in this paper hope to provide feasible ideas and suggestions for the protection of farmers’ rights and interests,and also hope to provide a reference for the smooth implementation of agricultural land expropriation. |
