| The COVID-19 epidemic has entered a new stage in China,this shows that with the concerted efforts of the whole country,epidemic prevention and control has achieved a major victory in China.Personal information also act as a crucial part in the fight against COVID-19.For example,when there was a confirmed case in a region,administrative organs would collect the personal information to determine the spread path,in hope to prevent the spread of the virus to the maximum extent,and realize the administrative purpose of safeguarding people’s health.The Personal Information Protection Law officially issued in August 2020,which provides a new basis and perspective for the protection of personal information.However,in the course of practical work,there are still many problems.The malpractices in these practices expose the unreasonable application of the Personal Information.Based on the discussion above,this paper takes the prevention and treatment process of prevent infectious disease as an example to analyze the personal information protection during the prevention and control of epidemic disease.This paper is divided into four parts.The first part is the definition,classification and characteristics and right attribution of personal information in the prevention and control of epidemic disease.The second part is to analyze the legal basis,including the legitimacy of personal information processing,the necessity of protecting citizens’ personal information,the balance of value between public interests and personal information.The third part points out the specific problems during the prevention and control of COVID-19.It includes four aspects: unclear subject and scope of personal information collection,failure of informed consent principle in the process of personal information processing,inadequate supervision of administrative organs and vacancy of rights relief.The fourth part is the suggestion of personal information protection in the course of control and treatment of epidemic disease.As can be seen from the prevention and treatment of COVID-19,personal information has played a pivotal role during we take control and treatment of epidemic disease.Therefore,we should pay more attention to personal information protection,to achieve the goal of protecting citizens’ legitimate rights and interests,and to stabilize social and public order. |
