With the rapid development of information technology,digital economy has become the core driver of economic development in the new era,and the process of human informatization has entered the "big data era".In this era,data is everywhere and pervasive,and it is constantly optimizing our economic model and changing our way of thinking,gradually becoming a social resource as important as productivity and labor.Along with the scale development of public data,the increasing value of big data and theoretical and practical exploration of data rule of law,a lot of problems have come up.Due to the lack of theoretical and legislative support,the legitimate data behavior of private individuals in practice is not legally guaranteed,and the improper data utilization is not legally sanctioned,which makes the development and utilization of public data in the big data environment greatly hindered.In order to promote the development and utilization of public data,this paper will start from the background of the right to use public data,draw out the significance of private individuals as data subjects,and then argue the legality and legitimacy of private individuals’ enjoyment of the right to use public data by comparing the connotation and power of the right to use public data and the right to know embodied in the government information disclosure system.The exercise of rights is relative in nature,and while private individuals enjoy the right to data,the boundaries of the exercise of this right need to be strictly defined,and on this basis,a general grasp of the current state of research on the open use of public data in terms of broad principles,legislative safeguards,rule development and judicial remedies is made,and the logical basis for system construction is proposed to provide guidance for the construction of a system for the use of public data by private individuals and to gradually promote the rule of law and systematization of this system practice.
