| International cyberspace is still in the era of jungle rules,but the contest for data sovereignty has quietly begun.Due to the intertwined impact of various factors such as the economy,the governance of data sovereignty is extremely difficult.With the increasing importance of the value of data,ensuring the security of data sovereignty is crucial to the normal operation of the national economy and society,and it is also an important responsibility that sovereign countries cannot shirk.Based on the research background and significance of national data sovereignty legal protection,this paper analyzes the existing concept of data sovereignty based on relevant research results at home and abroad,and compares and analyzes the international and domestic legislative practices of data sovereignty legal regulation from the perspective of international regulation of data sovereignty on the basis of clarifying the relationship between information sovereignty,network sovereignty and national data sovereignty,in order to bring reference and warning significance to China.In view of the data sovereignty game between countries,the cross-border flow of data,the data hegemony of major powers,and the characteristics of data processing itself,it is difficult for countries to effectively exercise data sovereignty.As a signatory to RCEP,China should take this as an external driving force,expand the level of openness of cross-border data flow on the basis of adhering to the concept of national security,build China’s national data strategy on the basis of the difference in the data sovereignty rules of the EU and the United States,based on the principles of sovereign equality and cooperative governance,and in line with the concept of a community with a shared future in the network.Establish a more balanced,comprehensive,consistent and open international digital rule of law pattern between the free flow of data and cross-border data control,and promote the comprehensive and healthy development of the global digital economy. |
