| In recent years,the network live broadcast industry has developed rapidly,and various kinds of online live broadcast platforms are increasing continuously.The "live broadcast +" mode has achieved excellent results in many fields.However,at the same time,due to the profit-seeking of online broadcast platforms,they ignore their regulatory responsibility,and the phenomenon of anomie in the platform occurs frequently,so they must be regulated.Because the administrative law has the unique advantages in regulating the network live broadcast platforms.Therefore,with the title of the administrative regulations of the network broadcast platform,this paper explores how to realize the full and effective regulation of the network broadcast platform through the administrative laws.The first part of the article defines the relevant concepts of the network live broadcast platform,starting from what is the network live broadcast platform and how to understand the network live broadcast platform,and further expounds the special features of the network live broadcast platform different from other network platforms.And what is the administrative regulation system of the network broadcast platform,and how is it different from the traditional administrative regulation system.The second part discusses the necessity of administrative law and legal regulation on network live broadcast platforms,and makes specific analysis from three dimensions of real demand,legal regulation demand and demand for adjusting new legal relationship.First,frequent occur in online live broadcast platforms in real life,and need to be regulated.Secondly,the criminal law and the civil law system are limited,while the administrative law system has unique advantages.Finally,the legal relationship in network live broadcast platform is complex,and the legal status of network live broadcast platform and platform users is different,which can be corrected by administrative law.The third part analyzes the current situation and problems of administrative regulations in China,and discusses them from the aspects of legislative system and legislative content.In the legislative system,the decentralized legislative model brings about problems such as fragmentation of legislation and lack of leading legislation.In terms of legislative content,there are some problems,such as backward regulation mode,single regulation means,excessive regulatory subjects and imperfect regulatory system of network broadcast platforms.In the fourth part,aiming at the problems in the administrative regulations of China’s online broadcast platform,some targeted suggestions are put forward,including changing the legislative concept,no longer pursuing the regulatory goal of zero risk,and adjusting the legislative ideas.The unified legislative mode is adopted to improve the systematic level of administrative regulations of network live broadcast platforms.In addition,it should improve the content of administrative regulations on online live broadcast platforms,set up special regulatory subjects,optimize the traditional regulatory system,strengthen the use of flexible regulation means,improve the administrative legal responsibility of online live broadcast platforms,and guide the online live broadcast platforms to strengthen industry self-discipline. |
