| Driven by the development of digital technology and policy factors,China’s music market has entered the process of legalization,and the demand for music copyright transactions has increased significantly.The copyright system’s embodiment is copyright licensing,a crucial connection in recognizing the worth of works.The traditional licensing model has been unable to satisfy the requirements of all parties in the digital age for musical works,making it hard to harmonize the interests of digital music content providers,online music service providers,and end users in China’s music market.This is due to the sluggishness of digital music works’ development,resulting in low licensing efficiency,despite the abundance of licensing mechanisms available.This paper examines the issues of the current copyright licensing model,taking into account the current practice of digital music copyright licensing in China,to either upgrade the existing model or create a new one to maximize the value of music works in the digital environment.In addition to the introduction and conclusion,this article is composed of four main sections.Exploring the digital music copyright licensing model,this part delves into the legal implications of copyright licensing,mainly examining the statutory,collective management organization,and exclusive licensing models in China.An examination of the quandary of the copyright licensing system for digital music works,as it relates to the practice of copyright trading in China’s music market,is conducted in the second part.The deficiencies of the statutory licensing model are then highlighted.lie in the unclear legislative value,unclear application conditions,and lack of a system to protect the interests of right holders;The limitations of the collective management licensing model lie in the disconnect between legal provisions and practice,loopholes in the management mechanism of collective management organizations,and lack of supervision mechanisms;The problems of the exclusive licensing model are that it causes vicious competition,restricts the efficiency of dissemination of works,and involves monopoly risks in copyright concentration.The third part examines the relevant legislation and innovation experience of the copyright licensing model of music works in foreign countries for the purpose of comparative research,so that the exploration experience of foreign countries can provide new inspiration for the improvement of China’s digital music model.The fourth part mainly puts forward some suggestions to improve the current licensing dilemma of digital music licensing model in China.First of all,we should adjust the legal license mode of digital music works copyright by clarifying the legislative value of legal license,refining the applicable conditions of digital music legal license system and strengthening the protection of rights holders’ interests;Secondly,by perfecting the corresponding legislation,introducing blockchain technology and improving the supervision mechanism,Standardizing the collective management of digital music works’ copyright licensing,regulating the "exclusive license sub license",establishing a time limit and quantity of works,and introducing anti-monopoly law to restrict exclusive license mode,is the third step.To satisfy the diverse needs of ecommerce users,an online licensing platform is proposed.all parties. |
