An Empirical Study On The Problems Of Grassroots Civil Procuratorial Supervision Mechanism

Civil procuratorial supervision is an important legal supervision responsibility of procuratorial organs.With the successive amendments to relevant laws in China,research on civil procuratorial supervision has yielded many theoretical results,ranging from theoretical discussions to empirical research.Given that civil procuratorial supervision is close to the frontline of judicial practice and closely related to the practical work of procuratorates and courts,this article is based on the author’s 6-month research results in the procuratorates,combined with the relevant data in the work reports of the procuratorates of ten counties and districts in S City and specific civil procuratorial supervision cases,to attempt to study the current situation and working methods of grassroots civil procuratorial supervision.Firstly,through empirical analysis and other methods,this study mainly analyzes and sorts out the practical data of civil procuratorial supervision of grassroots front-line procuratorial organs from 2018 to 2022,reveals the characteristics and existing problems of civil procuratorial supervision,and strives to explore its internal logic and connections.Secondly,based on the data analysis,this study attempts to reveal the factors that affect civil procuratorial supervision by combining conversations with front-line prosecutors and procuratorial work reports.Through analysis,it is found that the revision of the law,the adjustment of the internal structure of the procuratorial organ,the education and rectification of the national political and legal system,and the professional ability of the frontline procuratorial team are the main factors affecting the civil procuratorial supervision work in recent years.Finally,this study combines the actual situation of current procuratorial organs and research results,and puts forward some suggestions for improving the current civil procuratorial supervision work by analyzing several major factors that affect the current civil procuratorial supervision work.The specific suggestions are: to improve the relevant laws of the civil procuratorial supervision system;Strengthen the connection with the masses and improve the awareness of safeguarding rights of the group;Optimizing the staffing of civil procuratorial supervision departments;Improve the internal mechanism of the procuratorial system and build an integrated work pattern.With a view to providing assistance for the improvement and further promotion of the current grassroots civil procuratorial supervision work.
