Research On The Quality Assessment Of Criminal Legal Aid Cases

Criminal legal aid as a state responsibility,rights protection is its logical starting point.Quality assessment of criminal legal aid cases has been used to monitor criminal legal aid cases worldwide to ensure and improve the quality of cases.However,without practice experience and theory lag,quality assessment of criminal legal aid cases in our country still has problems such as incomplete assessment standards,uncomplicated assessment subject and assessment method,and not giving full play to the role of assessment results.By building a scientific and effective quality evaluation system for criminal legal aid cases,the problems existing in the evaluation practice can be solved to a certain extent,and the quality of criminal legal aid cases can be improved,so as to more effectively protect the rights of criminal aid recipients.Based on this,this paper takes the protection of the rights of criminal aid recipients as the entry point,focuses on the current quality assessment predicament of criminal legal aid cases in China,combines advanced experience from outside the country and advanced theories from other disciplines,and explores the quality assessment system of criminal legal aid cases with Chinese characteristics.The paper is divided into four chapters to carry out research.The first chapter is an overview of the quality assessment of criminal legal aid cases.This chapter expounds the connotation and related contents of the quality of criminal legal aid cases and the quality evaluation of criminal legal aid cases,and expounds the necessity of carrying out the quality evaluation of criminal legal aid cases from two perspectives of realizing the effective defense of criminal legal aid cases and making up the lack of external supervision and control of the quality of criminal legal aid cases.The second chapter discusses the quality evaluation of criminal legal aid cases.This chapter reviews the history of quality assessment of criminal legal aid cases,introduces the current situation of standards and practice of quality assessment of criminal legal aid cases,and summarizes the existing defects and reasons of assessment.The third chapter is the extraterritorial experience of quality assessment of criminal legal aid cases.The study and reference from foreign advanced experience is beneficial to build our country’s quality assessment system of criminal legal aid cases.This chapter mainly summarizes foreign advanced methods in assessment subject,assessment criteria,assessment methods and assessment results.The fourth chapter is to perfect our country’s criminal legal aid case quality evaluation suggestion.We unifies our national condition and overseas relevant experience under enlightenment.This chapter proposes that a scientific and effective quality assessment system of criminal legal aid cases should be constructed in strict accordance with the principle of peoplecentered,systematic and different.
