Educating criminal suspect is a function of investigative interrogation with Chinese characteristics.The Guidance on the Application of the System of Pleading Guilty to Punishment with Leniency,jointly issued by the two high and three ministries in 2019,specifically emphasizes the importance of the public security organs in carrying out education on pleading guilty,which has also aroused the attention of theoretical and practical circles on guilty plea education,but there is a lack of research on the topic of education on pleading guilty.In the practice of investigation and interrogation,there are many problems in guilty plea education,which restrict the effectiveness of confession education.In view of this,this paper adopts such research methods as questionnaire survey,in-depth interview and grounded theory to comprehensively and deeply introduce the current situation and existing problems of guilty plea education in investigative interrogation,systematically analyze the influencing factors of the effect of guilty plea education,and on this basis,propose targeted suggestions to improve the effect of confession education.In addition to the introduction and conclusion,this article mainly includes the following four parts:Chapter 1: Overview of the guilty plea education in investigative interrogation.This chapter defines the concept of guilty plea education in investigative interrogation,explains the theoretical basis of guilty plea education from a multidisciplinary perspective,discusses the policies,laws,ethics,outlook on life and values,as well as the situation and future used in guilty plea education,and clarifies the functions of guilty plea education in investigative interrogation.Chapter 2: The current situation and existing problems of confession education in investigative interrogation.Based on the questionnaire survey data,this chapter analyzes the current situation of guilty plea education in investigative interrogation from two aspects: the use of guilty plea education by investigators and the motivation of suspect after guilty plea education,and points out the existing problems,mainly including the low frequency of confession education,the unknown stage and object of guilty plea education,the process of confession education becoming a mere formality,the lack of trust in the object of guilty plea education and the unsatisfactory results of guilty plea education.Chapter 3: Factors influencing the effectiveness of guilty plea education in investigative Interrogation.Based on 27 text materials obtained from interviews with investigators,this chapter uses the grounded theory to analyze the deep influencing factors of the effect of guilty plea education in investigative interrogation,including four aspects: the subject of guilty plea education,the object of guilty plea education,the information of guilty plea education and the situation of guilty plea education,and constructs a theoretical model to explain the influencing factors.Chapter 4: Suggestions for improving the effectiveness of guilty plea education in investigative interrogation.Based on the problems and influencing factors of guilty plea education in investigative interrogation,this chapter proposes the following suggestions: Firstly,to change the interrogation concept,investigators should maintain an open mindset and adhere to a humanistic education concept;The second is to improve the quality of interpersonal communication.Investigators should maintain active care,empathy,deep listening,etc.,and express effectively;Thirdly,establish a harmonious trust relationship with the educational object;The fourth is to optimize the quality and effectiveness of guilty plea education information by expanding its breadth,accuracy,depth,and using diverse expression methods;Fifth,pay attention to the situational factors of guilty plea education,grasp the timing of guilty plea education,and create a peaceful and communicative atmosphere;Six is to prevent the risk of false confessions from multiple perspectives.
