Study On The Path Of Transnational Cybercrime Governance From The Perspective Of Global Security Governance

The two major themes of the 21 st century are security and development,and cyberspace is also facing the problems of security and development.The global governance of transnational cybercrime responds to the general interests of all countries in the world to seek security and development,and meets the objective needs of maintaining international security and national security,so the research on the path of global governance of transnational cybercrime has great practical significance.At present,the mechanism of international governance of cybercrime mainly includes organizational mechanism,conference mechanism and treaty mechanism,and various mechanisms are more comprehensive on the whole,which can objectively play a positive role in the governance of cybercrime,but there are still many shortcomings in the vertical view,coupled with the obvious features of global transnational cybercrime of transnational cybercrime grouping and transnationalization,the crime depression effect is prominent,and the global cybercrime governance presents fragmentation.The current situation of fragmentation,at the same time,the lack of mutual trust and identity among countries,the obvious conflict of values and laws,the existing global governance mechanism of cybercrime is in urgent need of change.Based on the understanding of the connotation of global security governance theory,this paper analyzes the transnational cybercrime problem from the security dimension and governance dimension,uses literature analysis method,case study method and comparative research method,and proposes relevant governance paths from the perspective of sovereign states and international organizations,aiming to enhance the systemic nature of the global governance system of transnational cybercrime,so as to eliminate the transnational cybercrime threat in both traditional and non-traditional security aspects.threats.Specifically,from the perspective of sovereign states,it is necessary to continuously improve and optimize domestic laws and regulations;form a multi-body governance synergy by integrating domestic governance resources and integrate and promote the development of technology and talents to form a virtuous interaction of technology-talent development.From the perspective of international organizations,the cooperation level,relying on Interpol to carry out global law enforcement security cooperation;the normative level,to promote the development of cybercrime conventions under the framework of the United Nations;the capacity building level,focusing on making up for the shortcomings of the governance capacity of developing countries,to enhance the overall global governance effectiveness;the mechanism level,to build a transnational cybercrime comprehensive governance cooperation platform.Finally,based on China’s practice,as a major Internet power and the largest developing country,China is an important part of global cybercrime governance,so it must continuously optimize the path of China’s participation in global cybercrime governance based on practice,and lead the world in promoting consensus to enhance the identity of cyber sovereignty;platform construction,promote the "Belt and Road Initiative On platform construction,promote the cooperation and exchange under the"Belt and Road Initiative";on culture shaping,vigorously promote a people-centered cybersecurity culture;on value paradigm construction,actively promote the formation of a sense of community of destiny in cyberspace.
