Legal Research On Medical Dispute

A harmonious society cannot be separated from a harmonious doctor-patient relationship.The doctor-patient conflict that broke out during the COVID-19 exposed that the doctor-patient conflict is easy to intensify and even form social contradictions.After entering the 21 st century,under the background of accelerated urbanization and economic development,medical technology and medical environment are also improving.But people’s requirements for the treatment of diseases are also increasing;Economic regional differences make people habitually rush into large cities and hospitals for medical treatment,resulting in the shortage of medical resources and poor medical experience;The sudden outbreak of the virus has caught patients and hospitals unprepared,and other reasons have made the doctor-patient relationship not substantially improved at present.Medical disputes are developing towards a sudden and complex trend.The existing prevention and settlement mechanism cannot fundamentally solve the problem and cannot meet the needs of social diversity.The resolution of medical disputes not only depends on the government’s legislation,justice and law enforcement,but also involves the entire medical system,including hospitals,medical care and patients,as well as insurance companies and manufacturers of medical equipment and consumables.The resolution of medical disputes also requires the participation of multiple departments.This article combines the author’s experience as a member of the medical equipment industry,the long-term contact with the medical environment in Jiangsu Province,the contact with the medical staff of different medical institutions,the direct participation in the settlement of medical disputes in Jiangsu Province,and the witness of the changes in medical reform in Jiangsu Province.We will also consult the literature,analyze and understand the current situation,causes,focus and characteristics of medical disputes in China in combination with relevant domestic and foreign experience and laws.Analyze the classic cases of medical disputes in Jiangsu Province,the current situation of medical disputes in Jiangsu Province,etc.,and propose an operable and diversified solution mechanism for medical dispute resolution,reduce the contradictions between doctors and patients,build a harmonious doctor-patient relationship,and promote the continuous development of medical level.
