| Modern society is an information-based society,under the conditions of informatization,news works have had a profound impact on people’s lives with their rapid dissemination speed.With the rapid development of network technology,the value of news works in the information society is increasingly prominent.At the same time,online actors have a weak awareness of respecting and protecting the copyright of news works,leading to frequent incidents of copyright infringement of news works.Based on the above reasons,this article takes the issue as a guide,organizes the laws and regulations related to the protection of copyright in news works,analyzes the difficulties encountered in practice,and proposes corresponding protection suggestions.The full text consists of six chapters.The first part is the introduction section,which mainly introduces the background and significance of the topic selection,and sorts out existing literature to lay the foundation for the following text.The second part,the overview of news works,defines the concept of copyright of news works,expounds the journalism significance of news works and the copyright significance of news works,and analyzes the relationship between news works and simple factual information.The third part focuses on analyzing the relevant stakeholders in the dissemination of news works,mainly analyzing the producers and disseminators of news works.The fourth part is the dilemma of copyright protection for news works.The main focus is on the advancement of communication technology and the diversity of infringement behavior in the new media era,including the transcoding behavior of news content published on certain news release platforms’ portal websites or mobile clients that are not original,but display the news titles of other news release platforms,and link other people’s content on the platform.And the author modified the language and structure based on the work of others,and then "wrote" a new work in the form of copyright infringement.The flaws in the legal licensing system have led to some individuals creating news works not receiving corresponding compensation,making it difficult to realize the right to compensation claims,and the imbalance of interests between producers and disseminators of news publishing,resulting in the inability to effectively protect the rights and interests of news copyright owners.The fifth part,suggestions for copyright protection of news works,analyzes from two aspects: improving judicial protection of news works,clarifying substantive similarity rules for judgment,and optimizing compensation methods for infringement damages;Implement the legal licensing system by establishing reasonable payment remuneration to determine the scope of application of legal licensing for news works. |
