Research On The Supervision Of Commercial False Registration Under The Background Of Commercial System Reform

In March 2014,in accordance with the Plan for Institutional Reform and Functional Transformation of the State Council,the country vigorously promoted the reform of the commercial system,changed the "license before license" into "license before license",and carried out "wide access and strict control" on the establishment and operation of commercial subjects,thus greatly reducing the threshold of market access.Although the reform of the business system has effectively invigorated the market and opened a convenient door for mass entrepreneurship and innovation,there have been increasing cases of criminals taking advantage of the business registration facilitation for economic benefits to cheat the business registration.The illegal circumstances of false commercial registration are complex and diverse,which cause great harm to the society.Moreover,it is easy to intensify social conflicts and even induce crimes.Therefore,it is urgent to arouse the attention of regulatory authorities.At the same time,the market supervision department has not done a good job in dealing with such new illegal ACTS,and it appears powerless in supervision,which makes the problem of false commercial registration rampant.The endless acts of false commercial registration not only damage the personal rights and interests of the wrongdoers,but also seriously disturb the economic order of honest operation in the market,and even waste the administrative resources of the state and weaken the public credibility of the state.Therefore,it is of great practical significance to study and solve the problem of false commercial registration and restore the normal operation order of the market.This paper takes several cases of submitting false information to obtain registration in N District as an example.After sorting out and reviewing domestic and foreign researches on commercial registration reform and false registration,the theoretical framework of this paper is constructed based on information asymmetry theory and responsive supervision theory..Through case analysis and interviews with relevant personnel,Summarizes the commercial false registration problems existing in the supervision and put forward policy suggestions.This paper adopts the interview method,through in-depth interviews with the people involved in the case of false registration of commercial affairs and the business supervision personnel,and systematically expounds the performance of false registration of commercial affairs in the information asymmetry and the supervision problems.The results show that the false registration of commercial affairs is caused by information asymmetry,which is manifested in information asymmetry before,during and after the event.It is an effective attempt to alleviate the information asymmetry by using the theory of responsive supervision to explore regulatory countermeasures.Due to the lack of preparation for the implementation of commercial registration,information asymmetry has not been completely eliminated,resulting in frequent occurrence of false registration.By drawing on the theory of responsive regulation,this paper puts forward effective countermeasures for the false registration of regulatory businesses from three aspects: "response","coordination" and "technology".
